In pursuance of powers granted under the above Act and Order the Department of Local Government and the Environment does hereby REFUSE the following application made on behalf of:
Name: Mr A Hobbs Proposal: Erection of a detached triple garage with living accommodation over at: Malew House Malew Road Ballasalla Isle Of Man IM9 3DJ
which was considered on 1 February 2007, for the reasons set out below.

Reasons For Refusal:
- The new building is clearly a two bedroomed dwelling arranged above a large garage in an area where new residential development is generally not permitted. There has been no justification provided for the need for this additional accommodation, in addition to that available in Malew House which is in itself a sizeable dwelling.
- The building is of poor appearance in respect of the external soil stack and clumsy flat roofed dormer on the rear elevation. Furthermore, a number of established and what would appear to be large trees would need to be removed to make space for the proposed building.
NOTE 1. This refusal is without prejudice to a further application for a triple garage of standard internal dimensions and where the accommodation which is available in the roofspace may be used as such ancillary to that available in the main dwelling. The building should not be designed around the first floor accommodation which is effectively a new dwelling in the countryside.
This decision was made by the Director of Planning and Building control in accordance with the authority delegated to him under Article 3(13) of the Town and Country (Development Procedure) Order 2005
The decision contained in this notice does not become final until either;
- The time for requesting an appeal has expired; or
- Any appeal has been determined;
Whichever is the later.
Any appeal against this decision must be in writing and must be received by this Department within 21 days of the date of this notice.
