Planning Refusal Notice
Town and Country Planning Act 1999
Town and Country (Development Procedure) Order 2005
J G Kelly Homes Ltd Third Floor 19/21 Prospect Hill Douglas
In pursuance of powers granted under the above Act and Order the PLANNING COMMITTEE of the Department of Local Government and the Environment does hereby REFUSE the following application made on behalf of:
Name: J G Kelly Homes Ltd Proposal: Demolition of existing buildings and erection of residential development of three detached dwellings at: Land Between Sunnybank And Ellan Veen West Baldwin Isle Of Man
which was considered on 11 January 2007, for the reasons set out below.
Date of Issue: 15 January, 2007
Murray House Mount Havelock Douglas Secretary Planning Committee
Reasons For Refusal:
- It is considered that the proposed layout and design of dwellings would result in a development of a suburban appearance, that would detract from the character and appearance of the village. Furthermore, the position of the proposed dwelling on plot 3 would reduce the level of residential amenity currently enjoyed by the occupiers of ‘Ellen Veen’ given the proximity of the proposed dwelling to the boundary.
This decision was made by the Planning Committee constituted in accordance with Article 3(1) of the Town and Country Planning (Development Procedure) Order 2005.
The decision contained in this notice does not become final until either;
- The time for requesting an appeal has expired; or
- Any appeal has been determined;
Whichever is the later.
