Officer's Report
The Site
The site represents the curtilage of an existing property which lies on the south western side of Bay View Road opposite the lower access to Chapel Bay beach. The site stretches from Bay View Road back to a rear lane which runs from Victoria Road to Gelling's Avenue. The site accommodates a building which serves as a chemist's shop on the ground floor and with residential accommodation above.
Planning Status
The site lies within an area designated on the 1982p as Predominantly Shopping use. In the Port St. Mary Local Plan the site lies within an area designated as Mixed Use reflecting the variety of uses which are undertaken in the village centre.
Planning History
PA 87/4249 - replacement of shop front - permitted and
PA 00/2140 - installation of uPVC windows to rear elevation - permitted.
The Proposal
Proposed here is an extension at the rear of the property to provide consulting rooms. This will be formed in the alleyway between the side of the building and the party wall with "Kenilworth" to the north. The extension will be single storey with a slightly sloping roof. Also proposed is the removal of the existing rooflight in the sloping roof above together with the re-roofing of this short expanse of roof.
Assessment
The proposed extension is very modest and will not have an adverse impact on the appearance of the property or its use. There are no objections to the application.
Whilst access for the disabled should be encouraged, access to this new facility is afforded from within the building. As such this is a matter for Building Regulation approval not planning. There would appear to be steps within the existing ground floor of the chemist’s shop and as such access from within the shop is likely to be limited for unassisted wheelchair users.
Party Status
The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.
Disability Access Officer refers to internal access which is a matter for Building Regulations not planning and as such should not be afforded party status in this instance.

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.
C 2. This permission relates to the creation of a consultation room as shown in drawings reference AT 828.1 and -2 both received on 5th October, 2006.
N 1. The applicant is encouraged to ensure that as far as is practicable the new facility is accessible and available to disabled persons.
