Refusal Decision Notice
Town and Country Planning Act 1999
Town and Country (Development Procedure) Order 2005
EMC Design 80 Bucks Road Douglas IM1 3AF
In pursuance of powers granted under the above Act and Order the Department of Local Government and the Environment does hereby REFUSE the following application made on behalf of:
Name: Mr & Mrs C Murphy Proposal: Alterations and erection of covered parking for three vehicles with ‘granny flat’ living accommodation above at: Ballavale Farmhouse Ballavale Road Santon Isle Of Man IM4 1EH
which was considered on 18 December 2006, for the reasons set out below.
Date of Issue: 21st December, 2006
Murray House Mount Havelock Douglas (Signature)
Secretary Planning Committee (Signature)
Reasons For Refusal:
- Whilst there is no objection to the erection of new detached garaging, the proposed building would involve almost a full two storeys and create self-contained living accommodation which would be tantamount to a new dwelling in the countryside in terms of its use and its appearance. Whilst a condition could be attached tying the occupation of the new building to that of the main house, the fact remains that it is a self-contained two bedroomed unit which looks like and for all intents and purposes is, a new dwelling in an area which is not designated for such development.
This decision was made by the Director of Planning and Building control in accordance with the authority delegated to him under Article 3(13) of the Town and Country (Development Procedure) Order 2005
