The application site represents the curtilage of a dwelling located to the north east of Douglas Street, Peel.
The site lies within an area zoned as Mixed Use in the Peel Local Plan 1989 and within the designated Conservation Area.
There have been no previous planning applications relating to the application site.
The application seeks approval for the replacement of timber frame sliding sash windows to the front and rear elevations with upvc casement windows.
Peel Town Commissioners advise that they approve the application and the Department of Transport Highways Division raise no objection.
The application site is located within the Peel Conservation Area and as such, the proposal is considered against the provisions of Planning Circular 1/98, The Alteration and Replacement of Windows.
In particular, Category b) Paragraph 6 states, "If the original windows are in place they should preferably be repaired. If repair is impracticable, replacement windows which would be readily visible from a public thoroughfare MUST HAVE THE SAME method of opening as the originals. Whatever the material used in their construction, the windows MUST HAVE THE SAME pattern and section of glazing bars and the same frame sections as the original windows."
The windows proposed are upvc casement windows, described as being equal split with sash horns and would therefore not replicate the existing windows in either the method of opening, or the sections of glazing bars or frame sections as the original windows. As such the proposal is considered to be contrary to the provisions of Planning Circular 1/98.
As previously stated, the application site lies within the Peel Conservation Area, an area in which any new development or alterations to existing buildings in the area must preserve or enhance the character and appearance of that area. Windows and doors make a positive and readily visible contribution to the appearance of the Conservation Area and in this particular area, a significant number of properties have either retained their existing windows or replaced windows with the original opening style in either wood or upvc. It is considered that the introduction of upvc casement windows in this location would detract from the character and appearance of the street within this part of the Peel Conservation Area.
It is recommended that the application be refused.
Whilst the application is recommended for refusal, should the application be subsequently approved, the following conditions are suggested:
1) The development hereby permitted shall commence before the expiration of four years from the date of this notice. 2) This approval relates to the plans and information submitted as part of this application and date stamped 7th September 2006. 3) The horns indicated must be attached at the same time as the windows are installed and thereafter retained.
The local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5)(c) and (d), considered "interested persons" and as such should be afforded party status.
It is considered that all parties, who submitted comments accord with the requirements of Planning Circular 1/06 and are therefore, afforded interested party status.

R 1. The proposal is considered to be contrary to the provisions of Planning Circular 1/98, insofar as the method of opening, pattern and section of glazing bars does not replicate the existing windows.
R 2. The installation of upvc casement windows in this property would detract from the appearance of the dwelling within streetsce, thereby neither preserving or enhancing the character and appearance of the Conservation Area in which the dwelling is located.
