The site defined in red on plan reference AT803.3 Rev1, represents a small portion of land in the heart of Middle Cordeman Farm, located to the north of the Bayrauyr (B30) and to the west of the Cordeman Road. The farm itself, which is incompletely defined in the above plan, stretches from this site northwards and southwards to the Bayrauyr. The previous application (see below) indicated that the farm extends to 250 acres of grassland.
The site is designated on the Isle of Man Planning Scheme (Development Plan) Order 1982 as white land, that is, not designated for development.
The following applications have been submitted in respect of this site:
Proposed here is the erection of one of the dwellings proposed in PA 06/0830. This application was refused as one of the dwellings was considered in an inappropriate location too far from the farm group and two dwellings were not considered justifiable in respect of the existing holding. The siting and design of the dwelling now proposed is the same as one of the dwellings proposed previously, to which there was no objection.
Whilst Malew Parish Commissioners has indicated that the application should be refused as no means of access has been indicated, the previous application was not refused for this basis and the reasons for refusal clearly indicated that it was only one of the dwellings which was considered unacceptable. The access to the new dwelling is via the Cordeman Road - a public highway then across a private road over which the applicant has a right of way, which also leads to at least two other properties. The previous refusal indicated in a note that any future applications should include ways in which the access could be improved. As this proposes only one dwelling, which may result in a reduction in traffic visiting the site, it may be considered inappropriate to require such improvements, namely widening parts of Cordeman Road where the farmland abuts the roadway. The Department of Transport has indicated that it has no objection as the traffic generated by one dwelling will have little effect on the Cordeman Road.
The dwelling is modest and appropriately designed and as such I consider that the proposal addresses the reasons for refusal given previously in respect of PA 06/0830. The advice of the Department of Agriculture, Fisheries and Forestry clearly supported the provision of one on-site dwelling in the interests of security and animal welfare.
The Manx Electricity Authority and Isle of Man Water Authority's concerns may be dealt with by notes.
The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.
Whilst Manx Electricity Authority and Isle of Man Water Authority represent statutory authorities, the points raised in correspondence relate to servicing and supply matters and not strictly planning issues and as such should not be afforded party status in this instance.

The development hereby permitted shall commence before the expiration of four years from the date of this notice.
This permission relates to the erection of a farm worker's dwelling as shown in drawings reference AT803.3 Rev 1 and AT803.2 both received on 2nd August, 2006.
The occupation of the proposed dwelling(s) must be limited to persons whose employment or latest employment is or was in agriculture in the Island and including the dependants of such persons as aforesaid.
The rooflights to be installed in the property must be conservation type as shown in the approved drawings. Notwithstanding the provisions of the Town and Country Planning (Permitted Development) Order 2005, no other rooflights may be installed at the property without the prior permission of the Planning Authority.
Notwithstanding the provisions of the Town and Country Planning (Permitted Development) Order 2005 (or any Order revoking or re-enacting that Order) no extensions, greenhouses, walls, gates, fences, garden sheds, summerhouses, flag poles, decking, garages, or tanks for the storage of oil for domestic heating shall be erected (other than those expressly authorised by this approval.)
The applicant is advised that there are Underground Cables/Overhead Lines present in the area indicated in the planning application. Please contact Anthony Kinrade or Ian Horsey, Operations and Maintenance Department, Network Services, Manx Electricity Authority, (Tel. 687705) to discuss working practices around Cables and Overhead Lines which may be required to be diverted before any work can be carried out on site.
The applicant is also advised to contact the M.E.A. for Electrical Site Safety 5 documents, (Tel. 687766), before any work is carried out on site. All work to be carried out with reference to Health and Safety Executive Guidance Notes HS(G)47 and GS6.
N 2. Prior to the commencement of work, the applicant must consult the Isle of Man water Authority in respect of the existing water main which passes close to the site of the proposed works.
N 3. The applicant is advised to contact the M.E.A. Planning Department (Tel. 687781), to discuss the electricity supply for this application.
