Officer's Report
The Site
The site represents the footprint of an existing building situated on the eastern side of Castle Rushen.
Planning Status
The site lies within an area of Mixed Use on the Casltetown Local Plan of 1991 and within an area of Mixed Use - Residential, retail, offices, public house, tourism on the draft Area Plan of 2001. The site also falls within Castletown's Conservation Area and the building is Registered (RB 65).
Planning History
The following applications have been submitted in respect of this site:
- PA 90/0032 - internal alterations to create additional shop unit - permitted
- PA 91/4132 - change of use from retail shop to estate agent's - permitted
- PA 97/0452 - erection of hanging advertising sign - permitted
- PA 98/2138 - erection of CCTV dome and removal of street light - permitted
- PA 06/0933 - Registered Building consent for the installation of two sliding sash windows to replace existing on rear elevation - pending consideration
The Proposal
Proposed here is the replacement of two existing windows in the rear elevation, first floor with new treated softwood windows. The new windows will be the same as the existing - ie sliding sash with subsidiary glazing bars subdividing each light into four equal panes, but there will be double glazed not single as existing.
Assessment
The windows are visible from the car park to the rear although from here, the difference in the glazing will be barely distinguishable to most. Planning Circular 1/98 suggests that where practicable the existing windows, where original, should be retained and where this is not practicable the windows should replicate the existing. The proposed windows will achieve this except for the windows being double not single glazed.
Conservation Officer'S Supplementary Report:
I have considered the content of the application with particular consideration to Policy CA/2 Special Planning Considerations as set out within Planning Policy Statement 1/01, and Planning Circular 1/98 The Alteration and Replacement of Windows, specifically 4. Category a) REGISTERED BUILDINGS.
The application was made following consultation between the Assistant Conservation Officer and the Applicant. The Assistant Conservation Officer visited the site and was able to view the poor condition of the existing windows. It is understood that those existing are not the original windows but are more recent replacement items. On this basis the proposal is acceptable.
I therefore recommend that the application be approved with the condition that a sample of the window be approved by the Planning Committee PRIOR to the works commencing on site.
Party Status
The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.
