Maughold Parish Commissioners
ObjectionThe Commission have concerns with the proposed use of uPVC on the frontage of this house as it is in a prominent position in the village.; They feel that only timber framed windows to the front elevation would maintain character and be in keeping with the location.; The use of uPVC on the rear elevation is not considered an issue and causes no concerns.
The original application for installation of uPVC sliding sash windows to the front and casement windows to the rear of Church House was permitted on 31 July 2006. Maughold Parish Commissioners lodged an appeal on 21 August 2006 under the Town and Country Planning (Development Procedure) Order 2005, requesting written representations procedure. The appeal was accepted and parties were notified, with the Department invited to submit their case by 14 September 2006. However, the appellant withdrew the appeal on 25 August 2006, just days after lodging. The original permitted decision therefore stands.
Precedent Value
This case demonstrates that third parties (such as parish commissioners) can appeal permissions under the 2005 Order but may withdraw if circumstances change, reinforcing that permissions stand unless successfully overturned. Future appellants should ensure commitment before lodging to avoid administrative burden.
