The original application 06/00663/B for a 4-bedroom dormer bungalow on Plot 121 Cronk Liauyr was permitted by the Planning Committee on 03.08.2006 despite neighbour objections from Mr & Mrs Kneale and Mr & Mrs Walmsley regarding proximity, overlooking, and boundary fences. Mr & Mrs Kneale appealed, arguing overdevelopment, excessive size, closeness to boundaries, and maintenance access issues. The applicant and Department defended the scheme as compliant with site constraints, providing adequate separation comparable to neighbours, sufficient parking, and acceptable street scene with proposed privacy fencing. The inspector found the dwelling's size and 1.2m side separations just acceptable in context but required 1.8m boundary fences within the site to prevent overlooking. The appeal was dismissed, confirming the approval with the added condition.
Precedent Value
This appeal shows that appeals against approvals can fail if inspectors find proposals acceptable in context with minor condition adjustments like privacy fencing. Future appellants should provide strong comparative evidence on separations and acknowledge modern maintenance methods.
