In pursuance of powers granted under the above Acts and Order the Department of Local Government and the Environment does hereby REFUSE the following application made on behalf of:
Name: Mr Christopher Leach Proposal: Erection of a steel framed building for use as a joinery workshop with storage area for horticultural and beekeeping equipment and erection of three polytunnels at: Ballacunner Smeale Road Andreas Isle Of Man
which was considered on 7 April 2006, for the reasons set out below.

Reasons For Refusal:
- The proposed building would by reason of its height, siting, massing and design introduce a prominent and incongruous feature into the landscape, which would cause demonstrable harm to the openness and character of the countryside and would be detrimental to the visual amenities of the locality. Furthermore, the applicant has not demonstrated that there is sufficient need to justify an excessively large building within the countryside to the detriment of the visual amenities of the locality.
- The applicant has not provided any evidence to demonstrate why other outbuildings within the application site are unsuitable for the proposed uses and therefore it would be inappropriate to allow a new building without first considering this information.
- This review has been considered by the Planning Committee on written evidence. Any additional submissions not previously circulated to interested parties are enclosed herewith.

- the time for requesting an appeal in relation to any decision at review has expired; or
- any appeal has been completed.
Note 2: Rights of appeal against the decision of the planning committee are attached.
