In pursuance of powers granted under the above Acts and Order the PLANNING COMMITTEE of the Department of Local Government and the Environment does hereby APPROVE the following application made on behalf of:

Name: Sefton Hotel Plc Proposal: Approval in principle for a mixed use development consisting of a four screen multi-plex cinema, a sixteen lane bowling alley, restaurants, apartments and parking at: Site Bounded By Lord Street, Fort Street, Cambrian Place And Muckles Gate Douglas Isle Of Man

which was considered on 25 May 2006, subject to compliance with the conditions specified below.

Schedule Of Conditions:

1. This approval is in principle only and will remain valid for a period of two years within which time no development may take place until such time as details of the reserved matters (siting, design, external appearance, internal layout, means of access, landscaping) have been approved by the Planning Authority. Such reserved matters should form the subject of a single application.

1. The application for Reserved Matters must include a Transport Assessment which projects the number of arrivals and departures by staff, patrons, guests, and service vehicles and a Road Safety Audit; the application must demonstrate how

the above traffic movements will be catered for; the Assessment and Audit should be prepared in consultation with the Highway Authority.

1. The application for Reserved Matters must include full details of all drainage proposals, including site investigation to establish existing services, flow calculations, and arrangements for pool discharge and petrol interception; these details should be prepared in consultation with the Drainage Services Manager at Douglas Corporation.

1. No approval is hereby implied to the layout or disposition of the various uses as shown on the indicative drawings; the application for reserved matters must include an acoustic assessment, so ensuring that each use does not have adverse effects of the others.

1. The building should be designed in accordance with the following criteria:

(a) the building should be of modern architectural style using high quality finishes and detailing; (b) the elevations to Lord Street and Fort Street should include interest commensurate with the importance of the site to street-scenes within this part of the Town Centre; and (c) an element or elements of public art should be included as part of the design process.

1. The Reserved Matters application must include as assessment of the site's archaeological potential and a method statement demonstrating how the proposed construction would be undertaken such as to accommodate full investigation of such archaeological interest.

1. The building must be designed such as to accommodate the needs of disabled users in all respects.

NOTE The applicant is advised to consult the Water Authority with regard to the Water Supply Byelaws.

NOTE The applicant / developer is requested to consult with the Douglas Corporation to discuss the possibility of re-landscaping the land immediately east of the site as part of the proposed development.

Note 1: This permission refers only to that required under the Town and Country Planning Acts and does not include any consent or approval under any other enactment, bylaw, order or regulation.

Note 2: No works may be commenced until such time as -

• the time for requesting an appeal in relation to the decision has expired; or
• any appeal has been completed.

Note 3: Rights of the appeal against the decision of the planning committee are attached.

Note 4: An appeal must be requested within a period of 21 days.
