Amended Refusal Reasons
PA 05/01892 – application for plots, roads and sewers forming new residential development comprising 22 units, land including fields 334281 and 334282 adjacent to Springfield Terrace, Foxdale, Patrick Refused on review 11th May, 2006 Amended reasons for refusal: 1. The proposed development is not acceptable on the basis that: a) the demolition of “Lilybank” would result in the loss of an historically important building and one which is listed as having potential for Registration in the Foxdale Local Plan. Whilst the property may have been altered over the years, it is the historical association with the local mining industry which results in its interest and in the absence of a detailed study into this building in this context, it would be premature to permit the demolition of this building of interest, b) the visibility available to drivers emerging from the site onto Kionslieau Hill is not adequate to serve the development (this, together with the concern regarding the loss of “Lilybank” would suggest that the access to this development should be solely from the A24), c) the proposal fails to make adequate provision for the softening of the north eastern part of the site in accordance with the requirements of the Foxdale Local Plan (paragraph 3.50): the existing sod hedge and minimal planting indicated on the submitted plans is not considered to satisfy the requirements of the plan. Note: notwithstanding that this is an application for roads, plots and sewers, there would not appear in the submitted plans sufficient flexibility in the orientation and position of the proposed dwellings to make significant provision for solar gain or maximising opportunities for renewable energy and/or energy saving and efficiency.
