Officer's Report
The planning application seeks approval for the erection of an agricultural implement shed on field accessed off the Dhoon Loop Road in Maughold. The application site, which is adjacent to a wooded area containing significant mature trees, is within an area of high landscape or coastal value and
scenic significance under the 1982 Development Plan. The applicant has identified their land ownership and submitted a supporting statement as justification for the proposed development.
Maughold Parish Commissioners have stated that they have reservations over the size and impact of the proposed building in an area of high landscape value. The DoT's Highways Division has advised that they consider there to be no adverse traffic impacts arising from the proposed development. Two local residents have objected to the planning application on the grounds of perceived need, lack of agricultural justification and visual impact. One other local resident has expressed an interest in the planning application but has not put forward any views. SPMCE have highlighted concerns about the actual need for the proposed building.
In light of the nature of the planning application I consulted with DAFF's Agricultural Advisor. To date, and despite a chasing letter, no response has been received from DAFF. In light of the implementation of the new legislation necessitating decisions needing to be made on planning applications submitted under the old legislation I have decided to wait no longer and to report on the matter based on the known information.
Whilst, due to the proposed location and the existing adjacent mature tree screening I not fully accept the concerns regarding the visual impact of the building I am concerned that the agricultural need for the building has not been sufficiently explained. Given the contents of the objector's letters this causes me some concern and I have concluded that the proper decision is to refuse the planning application on the grounds of lack of sufficient justification. It is my intention that it will be implicit within the reason for refusal that a review submission that goes into greater detail may be able to provide the necessary justification. Accordingly, I recommend that the planning application be refused.

Based on the level and content of information contained within the planning application the Planning Committee is not persuaded that there is sufficient agricultural need to justify the setting aside the presumption against new build development in the countryside.
