In pursuance of powers granted under the above Acts and Order the Department of Local Government and the Environment does hereby REFUSE the following application made on behalf of:

which was considered on 9 September 2005, for the reasons set out below.

Reasons For Refusal:
- By reason that the proposed extension is partially constructed on the riverside retaining wall the proposed development would unacceptably prejudice:
A) the future maintenance of the adjacent river; and B) the structural integrity of the retaining wall.
NOTE The applicant is advised that the Laxey River is designated as a main river under the Land Drainage Act 1934. Accordingly, works within the proximity of a main river will need to be agreed with the Department of Transport Drainage Division.
It is recommended that any amended proposal is discussed and agreed with them prior to its formal submission.
NOTE This decision was made by the Planning Committee constituted in accordance with Paragraph 2 of Schedule 1 of the Isle of Man Planning Scheme (Development Plan) Order 1982.
