The site relates to Plot 12 on Carrick Bay View, Colby. It is part of a largely complete housing estate accessed of the Ballagawne Road. The Arbory and East Rushen Plan designated this area for residential purposes and was identified as Development Area 6.

PA 04/641 Erection of dwelling, Plot 12 – approved
This latest application seeks amendments to the approval under PA 04/641.
Compared to this approval the changes now proposed relate to:

There are also some internal changes in respect of layout.
The history is quite complicated in that one scheme was refused at Appeal. The subsequent application was refused. Approval was finally granted under PA 04/641. The main difference now is the projecting front gable. Given its orientation, the style of surrounding properties including Plot 9 to the rear and the absence of objections from dwellings alongside the main road, it is judged that the application is acceptable. The impact as seen from the road in visual terms is not sufficient to justify refusal.

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.
C 2. This approval relates to drawing numbers A001 and A002.
C 3. No development may commence until there has been approved by the Planning Authority a scheme of landscaping which includes indications of all existing trees and hedges within the site and details of any to be retained together with measures for their protection during the course of construction.
C 4. All planting, seeding or turfing comprised in the approved details of landscaping must be carried out in the first planting and seeding seasons following the completion of the development or the occupation of the dwellings, whichever is the sooner. Any trees or plants which within a period of five years from the completion of the development die, are removed, or become seriously damaged or diseased must be replaced in the next planting season with others of a similar size and species.
C 5. The dwelling shall not be occupied until the parking facilities and vehicular access have been completed to the satisfaction of the Planning Authority after consultation with the Highway Authority, and such facilities shall thereafter be so retained.
C 6. The proposed development must be connected to the public foul sewer in a manner acceptable to the Department of Transport Drainage Division and on terns and conditions, which must be agreed with the Division PRIOR to the commencement of any building works. All drainage works must conform to the requirements of the Department of Transports "Manx Sewers for Adoption" and all necessary inspections/surveys [including CCTV] are to be carried out at the developer's expense. It is also a legal requirement under the Sewerage Act 1999 that the Department (as the drainage authority) be advised, in advance, of the date of the connection of each dwelling to the public sewer(s). NOTE: Communication Fees will be payable to the Department of Transport in respect of each of the nine storage units.)
C 7. There must be no discharge of surface water to the main foul sewer.
N 8. The Chief Fire Officer recommends the installation of mains wired interconnected domestic smoke detection.
