Department Of Local Government And The Environment ### Memorandum TO: Director of Planning and Building Control FROM: Miss Sarah Corlett, Planning Officer REF: PA 04/2074 – creation of safe play area with fencing and storage shed, Arbory School, Main Road, Ballabeg, Arbory DATE: 25th August, 2006 ### Consideration Of Amended Plan The above application was approved on appeal on 9th March, 2006. Two of the conditions of the approval required further details to be provided of the proposed spillway and the 1.5m high fencing required along the southern boundary be submitted and approved prior to the commencement of any development. The applicant now provides details of these aspects of the development. The fencing is to be 1.525m high closely boarded arched headed timbers and complies with the “solid timber fence along that boundary” as suggested by the inspector in his report, adding that as “the most persons using the play area would be young children, the height of the fence need only be 1.5 metres”. The Inspector’s report makes no mention of the spillway although he does deal with the proposed steps regarding the drainage of the site and problems which have been encountered by the objector at “Strathallan”. The Department of Transport Drainage Division suggested in their correspondence to the original proposal, that a proper spillway must be constructed “to avoid any scour in the area”. Department of Transport Drainage Division have confirmed that they are happy with the further details of the spillway (see attached). The objector has responded to the additional information, expressing concern at “amendments” to the approved plans. This ignores the fact that these details were required by condition and are providing additional information not amending that which has already been permitted. The objector also suggests that the appeal included agreement on a metal not timber fence. However, the conditions of approval and Inspector’s report clearly require a timber fence and these details are acceptable in this respect. I recommend that the further details satisfy conditions 2 and 4 of the permission granted on appeal. Objectors: committed noted but not accepted Appeal conditions: applied with 23/8/06
