Department Of Local Government And The Environment ### Memorandum TO: Secretary to the Planning Committee FROM: Miss Sarah Corlett, Planning Officer REF: PA 04/1148 – amendments to approved Shoprite store to include installation of oil tanks and access steps, removal of additional tree, internal alterations to side and rear elevations and inclusion of ATM machine, Former Nursery Hotel site, Nursery Avenue, Onchan DATE: 11th May, 2005 ### Reconsideration Of Application At Review The above application was approved initially by the Planning Committee and a review hearing was requested and held on 31st March, 2005. The decision at review was deferred pending further information which was to be requested from the Environmental Health Inspector with respect to noise levels which may be being emitted from the proposed equipment. You may recall that whilst the application was for the installation of equipment including an electrical substation and ventilation equipment, the applicant had during the consideration of the application, gone ahead and installed the equipment despite the decision not having become final. I imagine that this was so that the store could open and function as soon as possible. One of the conditions imposed upon the approval required that, prior to the installation of the equipment, the applicant must have submitted to the Environmental Protection Unit details of the noise generation levels at source of each piece of equipment together with attenuation measures to comply with the above level. The Environmental Protection Unit must be satisfied that the prescribed levels can be complied with prior to the installation of said equipment. As the equipment has been installed and the above information was not supplied in accordance with the condition, the Planning Committee requested that I contact the Environmental Protection Unit and ascertain whether the equipment is achieving the prescribed levels as set out in the condition. I have now received a report from Simon Renton, which addresses this issue. He suggests that he could not hear any noticeable or annoying tonal noise although monitoring indicated that there may be tonal noise at 100 Hz third-octave from the refrigeration plant. His monitoring information is attached. He concludes my suggesting that 40 dB will “easily” be achieved during the day in the garden and 30 dB at the nearest residential house at night. He also states that it was not possible to measure the noise levels during the day as background levels were too high. I would recommend that we confirm the initial approval at review against which Mr. Quirk and Mr. Boon will have the right to appeal. Condition 3 will need to be amended to exclude reference to the submission of the information which has now been submitted. Department of Local Government and the Environment MEMO To: Sarah Corlett From: Simon Renton 4 May, 2005 PA 04/1148 New Shoprite Store, Onchan Further to your letter of 21 April, 2005 I have monitored compliance with the following noise condition: 1. The rating level of the noise emitted from the plant, shall not exceed LAeq, 1 hour - 40 dB daytime (0700 – 2300) and LAeq, 5 minute - 30 dB night time (2300 – 0700) as measured at the boundary of 33, Birch Hill Avenue. The rating level shall be measured and calculated in accordance with BS 4142:1997. Noise monitoring indicates a level of LAeq - 55 dB from the refrigeration and ventilation equipment at a distance of 2 metres from rear of the premises. Given the distance to the nearest residential premises is approximately 25m to the garden and 38m to the house, very approximately predicted noise levels would be 33 dB and 29 dB respectively. I could not hear any noticeable or annoying tonal noise, although monitoring indicated there may be tonal noise at 100 Hz third-octave from the refrigeration plant. It was not possible to measure these levels at the residential premises during the day as background noise levels were too high. Additional attenuation than that predicted above, may be achieved due to the large bank at the back Shoprite. Also both ventilation and refrigeration plant were on, whereas I was informed by the manager that at night the ventilation plant is likely to operate much less frequently. In any case 40 dB will easily be achieved during the day in the garden and 30 dB at the nearest residential house at night. Consequently at these levels I would not anticipate any complaints of noise nuisance from local residents. Please see attached monitoring results. ## Results {{table:86026}} 1.
