We enclose a planning application made on behalf of the Department of Trade and Industry (DTI) in respect of safety engineering works to the abandoned mine shaft and mine adit at Ballasherlogue. The shaft and adit are located at approximate National Grid Reference SC225704. The proposed works form part of a larger programme of safety engineering works, by the DTI, to a number of abandoned mine entries. Other proposed works are the subject of separate planning applications.
The disused shaft and adit are in a condition that represents a potential hazard to the public being open and giving access to disused mine workings. It is therefore proposed to carry out engineering works to render the shaft and adit safe from access. The works proposed will include the following:
It is not proposed to construct any temporary access road or track, because the choice of a steel grille and fencing will mean that no heavy equipment or vehicles will need to be taken to the site of the works. The installation will be done using light equipment transported either by hand, barrow or trailer.

Since the planning application is being made on behalf of the DTI there is no requirement for the payment of a planning application fee.
Prior to the submission of this planning application, we have on behalf of the DTI, consulted with Manx National Heritage and the Wildlife and Conservation Office of the Department of Agriculture, Fisheries and Forestry (DAFF).
Manx National Heritage made no specific comments on the proposed works to this shaft but have made general comments about the proposed programme of safety engineering works on this and other abandoned mine entries. These comments have been fully considered and taken into account in the method statements for the proposed works. A copy of our letter to Manx National Heritage dated 18 February 2003 is enclosed.
DAFF's Wildlife and Conservation Office commented that the adit grille should be designed to allow the free passage of bats and birds. These comments have been fully considered and taken into account in the method statement for the proposals and the selection of a steel grille to make this adit safe and will ensure that its value to wildlife is unaffected. The landowner has advised that bats are known to use the adit. Accordingly we have sought and obtained, under the terms of the Wildlife Act 1990, a disturbance licence in order to carry out the works. This licence, No. WLA/P009/03 dated 3 June 2003, expires on the 31 October 2003 and it will therefore be necessary to apply to DAFF's Wildlife and Conservation Office for an extension. However it is anticipated that a further licence will be granted subject to the same conditions in all other respects.
Copies of our letters to the Wildlife and Conservation Office of DAFF dated 12 February 2003 and 17 March 2003, together with a copy of the present 3 June 2003 disturbance licence, are enclosed.
We have also obtained the consent of the landowner, Mr E Lloyd Jones, together with an adjacent landowner, Walker Brother Limited, who own or have Mr E Lloyd Jones' consent to use land across which access is required. Copies of the DTI's letters requesting landowners consents, dated 24 July 2003 and 15 August 2003, together with Mr Lloyd Jones response, dated 4 August 2003, and Walker Brother Limited response, dated 4 September 2003, are enclosed.
