This application has been recommended for approval for the following reason. The proposal complies with General Policy 2 and Environment Policy 35 of the Isle of Man Strategic Plan 2016.

Officer’s Report THE APPLICATION SITE
1.1 The application site is the curtilage of the La Mona Lisa Restaurant, Glen Road, Laxey, which is a two-storey semi-detached property, located on a corner plot with the Glen Road located to the south and Minorca Hill to the north. The building has two storeys and sits along Glen Road and as it turns the corner onto Minorca Hill, it is single storey under a pitched, tiled roof. - 1.2 Customer access into the restaurant is off Minorca Hill with staff and vehicle access off Glen Road Laxey. - 1.3 Opposite the application site is the Laxey River, there is a history of flooding in the area and it is understood properties along this lower section of Glen Road have been affected by this. The DOI Flood Risk Viewer shows the property within an area of "surface water - high likelihood" THE PROPOSAL
2.1 The current planning application seeks approval for two parts firstly to remove the current chimney stack to the rear of the property to roof level with the installation of tiles to match the existing roof. - 2.2 Secondly is the replacement of the hardwood front door situated to the Minorca Hill side of the property. The proposed new front door is to be uPVC and have the appearance of a glazed half-moon to the upper side and two over two panels of which the upper two will be glazed. PLANNING HISTORY
3.1 The previous planning applications are not considered to be specifically material in the assessment of the current application. PLANNING POLICY - 4.1 The site lies within an area zoned as Predominantly Residential on the Area Plan for the East, Laxey Map. The property is within a Conservation Area and a Flood Risk - Surface Water, High Likelihood Area.
4.2 When looking at strategic plan policy the Isle of Man Strategic Plan 2016 contains two policies that are considered of specific relevance to the assessment to this application, General Policy 2 and Environment Policy 35. - 4.3 General Policy 2 states "Development which is in accordance with the land-use zoning and proposals in the appropriate Area Plan and with other policies of this Strategic Plan will normally be permitted, provided that the development:
4.4 Environment Policy 35 states, "Within Conservation Areas, the Department will permit only development which would preserve or enhance the character or appearance of the Area, and will ensure that the special features contributing to the character and quality are protected against inappropriate development."
REPRESENTATIONS
5.1 Highway Services have No Highways Interest in this application (22.03.21).
5.2 Garff Commissioners have considered the proposal and state the follow, "The location in the Conservation Area was noted. There were no objection to these proposals." (1.04.21).
5.3 DOI Flood Risk Management Division have considered the application and have "No Flood Risk Management Interest." (1.04.21)
6.1 The key issue to consider in the assessment of this planning application is the potential impacts upon the visual amenities of the street scene. DOOR
6.2 The proposed new door is of a more appropriate style for the overall Conservation Area than what is currently in place and as such the proposed door whilst in a uPVC material will enhance the Conservation Area when taking into account the door which is existing.
CHIMNEY STACK When looking at the existing property as a whole the chimney stack itself adds no particular architectural or historic interest to the property to warrant its retention. Whilst the chimney stack can be seen from all vantage points it is not considered to contribute to the appearance of the dwelling, its removal and re-roofing over to match the existing property is expected to create a uniform appearance throughout the roofscape.,
7.1 For the above reasons the proposal is considered to comply with General Policy 2 and Environment Policy of the Isle of Man Strategic Plan 2016 and therefore acceptable. INTERESTED PERSON STATUS - 8.1 By virtue of the Town and Country Planning (Development Procedure) (No 2) Order 2013 (Article 6(4), the following persons are automatically interested persons:
