ObjectionThe Commissioners cannot make comment under Section 27 (5) (a) to (k) of the Act, but wish to include the comments made by the Independent Inspector at the Planning appeal for this site, and the conditions laid down by the Planning Committee for the approval.; Malew Parish Commissioners submit it would be premature for the Department to issue a direction for demolition until the conditions laid down in the planning approval have been met, particularly in relation to the diversion of sewers and drains which must be carried out prior to the commencement of any works.; The Commissioners contend that to issue such a direction would be in direct contravention of the conditions laid down by the Planning Authority and the Independent Inspector.
Conditions requested: no works including site clearance (demolition) until main river designation of Silverburn River extended incorporating flood alleviation and mitigation measures to satisfaction of Planning Authority in consultation with Department of Transport (condition no 6); diversion of sewers and drains must be carried out prior to commencement of any works
