Application for the Variation of Condition 3 of Application 09/02059/B Regarding the Erection of an Equestrian Facility and Ancillary Buildings at Ballakaneen, Andreas Road, Andreas, Isle of Man, IS7 4EN
I write on behalf of Mrs Anne King, the landowner and applicant, in respect of the above site. Please find enclosed a planning application for the variation of Condition 3 in respect of the above development. As requested the original and 3 copies of the following information is submitted as part of this application:

Please find below a short statement in support of the proposed variation demonstrating this would not have a detrimental impact upon the site, the open countryside or the surrounding area and would not prejudice the use of the premises.
Supporting Statement
This statement is submitted in support of a planning application to vary Condition 3 of the existing planning permission (Ref: 09/02059/B). This consent has been implemented and the development of the equestrian centre completed and operational.
Condition 3 is worded as follows:
'The equestrian centre and ancillary buildings may be used only for the keeping of horses and animals and related feed and equipment in association with the occupation of the principal dwelling Ballakaneen House.'
The applicant and owner, Mrs King, is seeking to remove the wording 'in association with the occupation of the principal dwelling Ballakaneen House' to enable the equestrian centre and house to be used and occupied independently of one another. There is no planning reason why the two need to be linked and their separation will not create any subsequent issues which would affect the open countryside or surrounding area in any way. The use of the premises will remain the same as in the current context, an equestrian centre, and therefore remains appropriate for this site.
It is therefore proposed Condition 3 is amended to be worded as follows:
'The equestrian centre and ancillary buildings may be used only for the keeping of horses and animals and related feed and equipment.'
The amendment in this manner will retain the existing use of the equestrian centre and the main house albeit the direct link between the two will be severed. This will enable the equestrian centre to be operated by person(s) other than the owner of Ballakaneen House. This issue was discussed with Chris Balmer of the Isle of Man planning department during a meeting on 21st July 2015. Mr Balmer indicated that the proposed variation would not prejudice the use and operation of the site in the manner approved and there is no planning requirement for the equestrian centre and main house to remain linked.
Therefore, the variation of Condition 3 in the manner proposed would not have a detrimental effect on the site or surrounding area and as a result is considered to be acceptable.
