The officer noted the site is designated Residential on the 1990 Port Erin Local Plan and Mixed Use on the draft Southern Area Plan, characterised by a variety of uses including tourist accommodation.…
Housing Policy 5
Policy applies to future change from tourist to general housing. Tourist use exempts affordable housing requirement as it is not permanent residential. Officer noted approval avoids HP5 but future residential proposals would trigger it; no tension as both uses policy-acceptable but tourist slightly preferred on site merits.
Approved plans
This permission relates to the use of the eight apartments as shown in drawings K206/P/10-01, K206/P/10-03, K206/P/10-05 and K206/P/10-07 all received on 21st December, 2009 as tourist accommodation.
Time limit
The use must be taken up within four years of the date of this notice in order for this approval to remain valid after that time.
Tourist use only
The units may be used only as tourist accommodation where tourism is defined as set out below in accordance with the provisions of the Strategic Plan and for clarification may not be occupied as a person's main place of residence. Tourism has been defined by the Tourism Society as "the temporary short term movement of people to destinations outside the places where they normally live and work and their activities during their stay at these destinations" and it covers a very wide range of activities and types of development. This may include travel and visits for business, professional and domestic purposes as well as for holidays and recreation.
Occupancy register
The owner/operator shall maintain an up to date register of the names of all owners/occupiers of the individual units on the site and of their main home addresses and shall make this information available at all reasonable time to the Planning Authority.

Comments received
Estates and Housing Directorate and Port Erin Commissioners objected to the change of use due to the loss of affordable housing originally approved, while Highways Division raised no objection.
Key concern: loss of affordable housing originally approved and needed in Port Erin

ObjectionMy Directorate would therefore favour rejection of this application and reinforcement of the original decision in favour of affordable housing.; I would therefore request consideration of either rejection of this application or a condition to any new planning approval requiring the 25% affordable housing requirement to be applied.
Conditions requested: if approved, condition requiring 25% affordable housing (2 of 8 units)
Department of Transport Highways Division
No ObjectionThe Department of Transport Highways Division does not object to this application as there are no highway safety or capacity implications
