THE APPLICATION SITE AND PROPOSED DEVELOPMENT The application site comprises the curtilage of The Pavilion, Laxey Glen Gardens, New Road, Laxey. The proposed development comprises the installation of replacement windows and doors within the building. PLANNING HISTORY
Whilst the application site has been the subject of a number of previous planning applications it is considered that none of these are specifically material to the assessment of this current planning application.
REPRESENTATIONS Laxey Village Commissioners recommend that the planning application be approved. PLANNING POLICY
In terms of local plan policy, the application site is within a wider area of land that is designated as open space under the Laxey and Lonan Area Plan Order 2005. The building is also within Laxey Conservation Area. Policy L/CRB/PR/4 of the Laxey and Lonan Area Plan Order 2005 states:
"Where an area is designated as a Conservation Area, special attention must be paid during the consideration of all planning applications within the area, to the desirability of preserving or enhancing its character or appearance in accordance with the Town and Country Planning Act 1991 (12.(4)."
In terms of strategic plan policy, the Isle of Man Strategic Plan 2007 contains two policies that are considered specifically material to the assessment of this current planning application.
General Policy 2 states:
"Development which is in accordance with the land-use zoning and proposals in the appropriate Area Plan and with other policies of this Strategic Plan will normally be permitted, provided that the development:
Environment Policy 35 states: "Within Conservation Areas, the Department will permit only development which would preserve or enhance the character or appearance of the Area, and will ensure that the special features contributing to the character and quality are protected against inappropriate development."
Planning Circular 1/98 sets out the Department's policy for of the alteration and replacement of windows. In respect of buildings within Conservation Areas it states: "If the original windows are in place they should preferably be repaired. If repair is impracticable, replacement windows which would be readily visible from a public thoroughfare MUST HAVE THE SAME method of opening as the original. Whatever the material used in their construction, the windows MUST HAVE THE SAME pattern and section of glazing bars and the same frame sections as the original windows.
Windows not readily visible from a public thoroughfare must have the same or similar pattern of glazing bars as originals, but not necessarily the original method of opening, whatever the material to be used in the construction."
The planning application seeks approval for the installation of replacement windows and doors within the building. The proposal was the subject of pre-application discussions and has been specifically discussed with the Building Conservation Officer.
The proposed replacement windows and doors are a mixture of uPVC and wood that replicate the appearance of the existing windows and doors. The windows and doors on the front elevation, which are publicly visible, are proposed to be replaced in wood and those on the side and rear, which are generally hidden, are proposed to be replaced in uPVC. On this basis the proposal is considered to accord with the provisions of Planning Circular 1 / 98.
It is recommended that the planning application be approved.
It is considered that the following parties that made representations to the planning application meet the criteria of Government Circular 1/06 and should be afforded interested party status:
Laxey Village Commissioners.
