PLANNING STATUS AND RELEVANT POLICIES Within the adopted Isle of Man Strategic Plan 2007, the following policies are considered to be relevant in the determination of this application: General Policy 2
The application is seeking a planning permission for change of use to restaurant/cafe and takeaway. The applicant's have indicated the existing use is restaurant/café.
The Architectural Liaison Officer of the Isle of Man Constabulary has stated that "Historically, the trading hours of such premises have not been controlled and as a result, they can remain open until the early hours of the morning. Research has shown that late-night takeaway type premises act as 'honey pots'. They cause persons to remain in the area for an inordinately period of time increasing the opportunities for criminal or anti-social behaviour.
Whilst it is noted that the applicant has not stated an intention to operate during the early hours of the morning, it is imperative that this situation does not occur by default. I would therefore recommend that a condition be placed upon any approval granted in respect of the said applications to the effect that the premises may operate between 0800hrs and 2300hrs daily (except during special event periods specified within condition 2).
The area is commercial in nature. There is a separate restaurant above the premises which opens to 10pm in the evening. There are no residential properties in the vicinity of the application. The proposed use appears to be reasonable due to the surrounding uses. The Highways Division have not objected to the proposed use.
The notes suggested by consultees are not material planning considerations and for that reason are not attached to the report, as part of the recommendation.
I therefore recommend that planning permission be granted subject to conditions.
The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.
Disability Access Office have commented on non-planning matter and as such should not be afforded party status in this instance.
The Architectural Liaison Officer of the Isle of Man Constabulary has commented on material planning considerations and as such should be afforded party status in this instance.
Recommended Decision: Permitted

C 1.
The development hereby permitted shall commence before the expiration of four years from the date of this notice.
C 2. This approval relates to the use of the premises as a restaurant/cafe and takeaway; the premises may be operated only within the period of 0800-2300 each day, except during TT fortnight and Grand Prix fortnight when the operation may continue until midnight. The premises may only be operated outside the approved opening times on special occasions AND with prior written approval of the Planning Authority.
C 3. This permission relates to drawing numbers 1473-03 date stamped 6th August 2009.
I confirm that this decision accords with Government Circular No 09/09 Delegation of functions, 10/09 Delegation of Functions (Development Procedure), GC No 11/09 (Advertisements) and GC No 12/09 (Registered Buildings) all to the Senior Planning Officer
