Recommended Conditions
Recommended Conditions Should the appointed Inspector be minded to recommend to the Minister that the application be approved, the Department would suggest that the following conditions and notes are attached to the approval notice: C1. The development hereby permitted shall commence before the expiration of four years from the date of this notice. C2. This approval relates to the erection of a dwelling, Erection of a dwelling, Site Adjoining Glen Vine House, Main Road, Glen Vine, Marown as shown by 4101/L1 REV B, 4101/S1 A and 4101/P1C all received 24th August 2009. C3. The approved dwelling shall not be occupied until the existing dwelling has been demolished and removed from the site and the ground on which it sits has been restored to match the levels of the immediate surrounding land and finished with turf or allowed to grass over naturally. (If considered necessary, the Minister is advised that the approval could be deferred pending the conclusion of a Section 13 legal agreement between the applicant and the Department which would ensure that the existing dwelling is removed prior to the approved dwelling being occupied). C4. The roofs of the dwelling must be finished with dark natural slate. C5. All existing trees shall be retained, unless shown on the approved drawings as being removed. All trees on and immediately adjoining the site shall be protected from damage as a result of works on the site, to the satisfaction of the Planning Authority in accordance with its guidance notes (enclosed) and relevant British Standards (eg BS 5837: 1991), for the duration of the works on site and until at least five years following contractual practical completion of the approved development. In the event that trees become damaged or otherwise defective during such period, the Local Planning Authority shall be notified as soon as reasonably practicable and remedial action agreed and implemented. In the event that any tree dies or is removed without the prior consent of the Planning Authority, it shall be replaced as soon as is reasonably practicable and in any case, by not later than the end of the first available planting season, with trees of such size, species and in such number and positions as may be agreed with the Planning Authority.
