The officer noted that development plan policies had not changed since the previous approval of three dormer dwellings under PA 14/00209/B, which overrode the Area Plan brief for only two dwellings du…
General Policy 2
Requires development to accord with Area Plan zoning and briefs, respect site/surroundings in siting/layout/scale/design, not adversely affect landscape/townscape/amenity/road safety. Officer found non-compliance with brief overridden by prior approval and other compliant aspects like amenity, access, and screening.
Environment Policy 42
New development in settlements must reflect local character/identity, no inappropriate backland or loss of green spaces contributing to visual amenity. Proposal assessed as acceptable given edge-of-settlement screening, no neighbour objections, and appropriate density.
Strategic Policy 1
Development must optimise use of previously-developed/under-used land and efficient site use considering access/amenity. Tipped balance in favour of three dwellings as 'well-considered use' despite brief for two.
Strategic Policy 2 - Priority for new development to identified towns and villages
New development primarily in towns/villages or sustainable extensions. Site in 'Proposed Residential' zoning on edge of Castletown deemed appropriate.
Time limit
The development hereby approved shall be begun before the expiration of four years from the date of this decision notice. Reason: To comply with article 14 of the Town and Country Planning (Development Procedure) (No2) Order 2013 and to avoid the accumulation of unimplemented planning approvals.
Visibility splays
Visibility splays measuring 2.0m x 12.0m in both directions from the junction of the approved site layout with the access lane from which the site will be accessed off Malew Road shall be installed and retained. Nothing must be planted, erected or allowed to remain within those visibility splays that exceeds 1.05m in height. Reason: In the interest of highway safety.
Access lane surfacing
Prior to any of the dwellings hereby approved being built to damp proof course level, the access lane from which the site will be accessed shall, from its junction from Malew Road and the cattle grid adjacent to the dwelling known as 'Gardenfield', be made up with a Tarmacadam basecourse. Reason: In the interest of highway safety.
No objection subject to visibility splays of 2.4x23m (later amended), no obstructions over 1.05m, turning heads for larger vehicles, noting prior Malew Road visibility improvements.
No objection to the proposal.
