The site represents the residential curtilage of Halcyon Days, Main Road, Ballaugh. The property is a two storey detached dwelling which is located on the northern side of Main Road, and west of Ballaugh Village.
The application site is within an area recognised as being an area of 'White Land', under the Isle of Man Development Plan Order 1982. The site is not within a Conservation Area; but is within an area zoned as High Landscape or Coastal Value and Scenic Significance.
The previous planning application is considered relevant in the assessment and determination of this application:-
Erection of boundary wall with new vehicular access and driveway - 99/01358/B - APPROVED 12 August 2009 09/00793/R
Alterations and extensions to dwelling with new driveway and vehicular access - 97/01523/B APPROVED
PROPOSAL The proposal is a retrospective application which seeks approval for the additional use of conservatory for serving cream teas.
REPRSENTATIONS Ballaugh Parish Commissioners:- "no objections thereto, but as a room in the dwelling house is to be used for the serving of teas the commissioners query if this now requires the submission of a further application for change of use from residential to commercial use."
Highways Division:- "Do not oppose" The Authority has received no privately written representations objecting to the application.
ASSESSMENT/RECOMMENDATION The proposal which is currently in operation has occurred subsequently due the farm shop which also operates from the site. The proposal which is in operation uses the existing conservatory connected to the main dwelling house as a tea room. The tea room has a capacity of four tables and operates Monday to Sunday 12noon till 5pm.
The site is located a sufficient distance from any nearby residential dwellings, it is therefore considered the proposal would not result in any adverse impacts upon the residential amenities of these properties.
The site has already an area of hardstanding which provides parking provision but also turning facilities. The Highway Division have considered the application and have no objection.
Overall, it is considered that the proposal would completely comply with The Isle of Man Strategic Plan (20th June 2007), for the reasons set out in this report, accordingly, it is recommended that the application be approved subject to conditions.
