Mrs Cheryl Fyfe applied to remove the front wall and gate of her mid-terraced dwelling in Third Avenue, Onchan, to form a hardstanding parking area within the front garden. The officer acknowledged severe parking problems in Third Avenue, noting the proposal would reserve rather than increase spaces but was understandable given the constraints.
Policy O/RES/P/21 of the Onchan Local Plan (Planning Circular 1/2000)
Permits extensions and alterations to existing residential property where appropriate in terms of scale, massing, design, appearance and impact on adjacent property. The officer assessed the parking hardstanding as a minor alteration fitting within a residential curtilage, with no adverse impacts noted beyond minor street scene effect already accepted via precedents.
General Policy 2
Requires development to respect site/surroundings in siting/layout/scale/design, provide satisfactory amenity/ parking/access, and avoid unacceptable road safety/traffic effects or adverse character impacts. Tested against parking provision (acceptable per precedents), street scene (minor harm not outweighing benefits), and highways safety (no objection); no issues with ecology, views, or other tests.
Time limit
The development hereby permitted shall commence before the expiration of four years from the date of this notice.

Do not oppose subject to contacting Network Operations for highway works including dropped kerbs
Recommend approved for planning purposes only (superseding initial refusal recommendation)

Key concern: setting an undesirable precedent
Amanda Underwood
ObjectionIf permission was granted to 14 Third Avenue, this would then secure them a space for one car and another 'guaranteed' space in front of their property; not only it will have a detrimental effect on the current parking situation, but will spoil the present 'look' of the avenue; there are a number of young children who play and run up and down safely on the right-hand (even numbered) side of the pavement
Mr & Mrs G L Martin
ObjectionIf permission is granted to No 14 Third Avenue, which is on the side of the avenue without double yellow lines, this will set a precedent which we feel would exacerbate the parking situation
Onchan District Commissioners
ObjectionThe Commissioners recommend that the application be REFUSED for the following reasons:- 'That the proposal would set an undesirable precedent.'
Onchan District Commissioners
SupportThe Commissioners recommend that the application be APPROVED for planning purposes only and that the previous letter has been sent in error. Please therefore disregard the letter dated 12th May 2009.
