Officer's Report
The Site
The site represents an existing property situated on the corner of Gellings Avenue and Bay View Road in the heart of Port St. Mary. The property is a three storey brick faced building with substantial chimneys and a dominant tower on the corner. There is a shop front on the ground floor of the building which is rendered rather than brick faced. The rear elevation - that facing anyone coming down Gellings Avenue - is also rendered with full height external vent pipes visible.
The windows in the property are a mixture of flat headed, arch headed and round headed sliding sashes of varying heights. Windows in properties elsewhere in the streetscene include fixed flat headed lights in round headed apertures with bottom opening casements underneath.
Planning Status
The site lies within an area designated on the Isle of Man Planning Scheme (Development Plan) Order 1982 as Predominantly Retail.
Planning History
Planning permission was granted under PA 97/0727 for the change of use of the shop to the sale of fruit and vegetables.
THE PROPOSAL

Proposed is the replacement of the windows with plastic framed sliding sashes with heads to match the apertures in which they are to be replaced.
Representations
Port St. Mary Commissioners query which windows are to be replaced but raise no objection and indicate that the windows in the front elevation should be replaced as soon as possible.
Assessment
The property is not protected by Registration and the site does not lie within a Conservation Area. As such, as the property retains much of its original character the provisions of Planning Circular 1/98 require that where possible the windows should be repaired but that replacements replicating the original form and appearance will be acceptable. In this case the proposal is for the same method of opening as the originals with the same shape of window frame as the aperture, which would satisfy this requirement.
The applicant has clarified that the windows to be replaced are all of the windows except the shop front.
As such the proposal is considered to be acceptable.
Party Status
The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.
C 2. This permission relates to the replacement of the existing windows (other than the shopfront) with sliding sashes whose shape fit the apertures in which they are to be installed, as shown and described in the plans and information received on 16th April, 2009.
