In pursuance of powers granted under the above Act and Order the Department of Local Government and the Environment does hereby APPROVE the following application made on behalf of:

Proposal: Creation of an outdoor seating area and installation of awnings to front elevation with associated lighting and heating (Re-advertised due to amended plan received)
at: Bay Hotel Shore Road Port Erin Isle Of Man IM9 6HL
which was considered on 12th January 2010, subject to compliance with the conditions specified below.

Schedule Of Conditions:
- The development hereby permitted shall commence before the expiration of four years from the date of this notice.
- This permission relates to the creation of a decked area for seating in association with the operation of the Bay Hotel, together with diverted pedestrian footway, all as shown in drawing 1412-02A received on 2nd December, 2009 and 1412-01 received on 5th March, 2009.
- The diverted footway must include provision to enable a continuous, unstepped surface for users, including those with pushchairs and prams and those in wheelchairs.

- Access must be available to existing road gullies, service boxes and chambers underneath the decking.
This decision was made by the Senior Planning Officer in accordance with the authority delegated to her under Article 3(13) of the Town and Country (Development Procedure) Order 2005.
Guidance Note
This permission refers only to that required under the Town and Country Planning (Development Procedure) Order 2005.
Any appeal against this decision must be in writing and must be received by this Department within 21 days of the date of this notice.

The proposed development must not be commenced until either;
- The time for requesting an appeal has expired; or
- Any appeal has been determined;
Whichever is the later.
