The application site comprises the residential curtilage of a detached dwelling that is located at the junction of Bridge Road and the Silverburn River as it runs parallel with the access into Rushen Abbey in Ballasalla, Malew.
The proposed development comprises the erection of a flue onto the dwelling.
Whilst the application site has been the subject of a number of previous planning applications it is considered that none of these are specifically material to the assessment of the current planning application.
REPRESENTATIONS At the time of writing no representations to the planning application had been received. PLANNING POLICY
In terms of land use, the application site is not designated for any site specific purpose under the Isle of Man Planning Scheme (Development Plan) Order 1982. The application site is also with a Conservation Area.
In terms of strategic plan policy, the Isle of Man Strategic Plan 2007 contains two policies that are considered specifically material to the assessment of this current planning application.
General Policy 2 states:
"Development which is in accordance with the land-use zoning and proposals in the appropriate Area Plan and with other policies of this Strategic Plan will normally be permitted, provided that the development:
Environment Policy 35 states: "Within Conservation Areas, the Department will permit only development which would preserve or enhance the character or appearance of the Area, and will ensure that the special features contributing to the character and quality are protected against inappropriate development."
The planning application seeks approval for the erection of a flue onto the dwelling contained within the application site.
The level of development proposed by the planning application is considered to be modest and unobjectionable. The proposal does not harm public or private amenity and not harm the Conservation Area.
It is recommended that the planning application be approved.
