Reason: To comply with Article 26 of the Town and Country Planning (Development Procedure) Order 2019 and to avoid the accumulation of unimplemented planning approvals.
This application has been recommended for approval for the following reason. The proposal complies with Section 18(4) of the Town and Country Act (1999) and Environment Policy 35 of the Isle of Man Strategic Plan 2016.

1.1 The application site is within the curtilage of 30 Derby Road, Douglas which is a three storey mid terrace property situated to the North of Derby Road. - 1.2 The immediate streetscene is characterised by sliding sash windows with glazing bars, bay windows to the ground floor level and decorative details above the curved first floor windows, which No.30 does not have. THE PROPOSAL
2.1 The current planning application seeks approval for the replacement of both front and rear windows and the installation of a new rear door which is to be 1 over 1 panelled with glazing to the upper half. - 2.2 The windows to the front elevation are to be uPVC sliding sash with glazing bars and the rear windows are to be uPVC casement windows.
3.1 There are no previous applications which are relevant to this application. PLANNING POLICY - 4.1 The site lies within an area zoned as "Predominantly Residential" on the Area Plan for the East, Map 4 - Douglas. The site is not situated within a Flood Risk Zone but is situated within the Windsor Road Conservation Area.
4.2 Given the nature of the of the land designation and the property being within a Conservation Area, Section 18(4) of the Town and Country Planning Act (1999) is the most relevant in the assessment of this application. Followed by paragraph 7.29.2 and Environment Policy 35 of the Isle of Man Strategic Plan, which set out development in Conservation Areas will only be permitted where they preserve or enhance the character and appearance of the area. - 4.3 Due to the proposal being for replacement windows and doors, Planning Circular 1/98 is also relevant.
