Officer’s Report THE SITE
1.1 The site is the curtilage of Arbory Parish Hall which lies on the northern side of the A7 as it passes through Ballabeg. The hall has a relatively limited curtilage which extends back around 25m. THE PROPOSAL - 2.1 Proposed is the erection of a memorial stone to the left of the pedestrian entrance to the site. This will be 1m by 1.8 in area and the memorial stone 1750mm high with a clock inscribed showing eleven o'clock with a dedication below to all the people in Arbory Parish who endured the first and second World Wars and subsequent conflicts and in memory of John Donald Collister. The memorial stone will be made from granite or other polished stone. The parish shape is to be included with the names of those who lost their lives in the Wars included in the inscription. The proposed railings around the memorial will be 1.1m high, simple and vertical in form and black.
2.2 There is to be a new entrance into the memorial area from the public highway, removing the existing telephone box and relocating the existing post box. - 2.3 The hall itself is a memorial to Stuart Cooil who was killed in the First World War and thereafter the land was gifted to the Parish with the hall being built thereon.
3.1 The site is designated on the Area Plan for the South adopted in 2013 as Church Hall land for civic, cultural or other use. As such the proposal is complementary to that designation. As such the proposal should be considered in accordance with General Policy 2 as follows:
"Development which is in accordance with the land use zoning and proposals in the appropriate Area Plan and with other policies of this Strategic Plan will normally be permitted, provided that the development:
3.2 The site also lies within a proposed Conservation Area highlighted on the Area Plan documents. PLANNING HISTORY - 4.1 Planning approval was granted to the erection of a millennium stone under PA 99/01302/B and alterations to the hall were approved under PA 12/00093/B. Perhaps the most significant alteration was the change in roof tiles which was approved under PA 07/01829/B which re-roofed the building in new red coloured tiles which matched the original finish on the roof; tiles which had weathered to appear darker and less red. This was approved on appeal. REPRESENTATION - 5.1 Arbory Parish Commissioners indicate by way of letter received on 24th September, 2014 that they have no views on the application.
5.2 Department of Infrastructure Highway Services indicates that they do not oppose the application. ASSESSMENT - 6.1 The proposal will result in a change to the streetscene in terms of what is currently a telephone box set into a low boundary stone wall with post box beside, will become a memorial stone contained within an area bounded by metal railings. However, this is a modest change and one which brings community interest and involvement. It is not considered that this change is detrimental nor would harm the character of the area, whether it is designated as a Conservation Area or not.
6.2 The Conservation Officer indicates that it would be preferable to relocate the telephone box and is content that the applicants are considering whether it is needed and if so, it will be relocated to the other side of the path leading to the hall. 6.2 The application is recommended for approval.
PARTY STATUS 7.1 The local authority is, by virtue of the Town and Country Planning (Development Procedure) (No 2) Order 2013, paragraph 6 (4) (e), considered "interested persons" and as such should be afforded party status.
7.2 Department of Infrastructure Highway Services is granted interested party status under the Town and Country Planning (Development Procedure) (No 2) Order 2013 paragraph 6 (4) d.

C 1. The development hereby approved shall be begun before the expiration of four years from the date of this decision notice.
Reason: To comply with article 14 of the Town and Country Planning (Development Procedure) (No2) Order 2013 and to avoid the accumulation of unimplemented planning approvals.
N 1. The applicant is encouraged to relocate the telephone box somewhere close to the existing location.
Reason: to preserve the character and amenities of the area.
This approval relates to the drawings reference 00 and 02 received on 22nd September, 2014 and to the illustrations and description of the railings received by e-mail on 30th September, 2014
