In pursuance of powers granted under the above Act and Order the Department of Infrastructure determined to APPROVE a planning application by Mr \& Mrs Alan Townsend, Ref 13/00786/B, for the erection of an extension to replace existing conservatory at Wegberg 2 Cronk Drine Union Mills Isle Of Man IM4 4NG subject to compliance with the following condition(s):

This decision was made by the Development Control Manager in accordance with the authority delegated to her. This permission refers only to that required under the Town and Country Planning (Development Procedure) Order 2005. Any appeal against this decision must be in writing and must be received by this Department within 21 days of the date of this notice.

Please note that a copy of the Officer's report which led to the decision, together with correspondence relative to the application, are available for inspection at the Department.
The proposed development must not be commenced until either;
Whichever is the later.
If no appeal is lodged within 21 days of the date of issue overleaf, and this decision becomes final, the Department's public reference copy (counter copy) of the planning application may be collected by the applicant or their agent from Murray House.
Please note that if the counter copy of the application is not collected within THIRTY DAYS following the last date on which a planning appeal can be made it will be destroyed without further notice.

1.1 The site is the curtilage of an existing dwelling situated within Cronk Drine, a small cul de sac of 20 dwellings which all lie on the south eastern side of Lhergy Cripperty. The properties are similar in size and design - mainly single storey and some, like the application property, have elements of two storey accommodation. Many properties, like the application property have their gables facing the estate road. The application property backs onto the Railway Inn public house beer garden and the side garden of 6, Glen Hill, a large, detached dwelling to the east.
2.1 Proposed is the replacement of the existing lean-to conservatory which is located on the side (southern) elevation. The existing is 2.5m by 3.3m and 2.4m in height to the apex. The new structure will be a different shape - having a five sided rounded end and will project 3.9m from the existing wall of the house and will be 3.3m wide, the same width as the existing. The conservatory will be 3.3m high with a pitched roof, framed in uPVC with full length glazing to ground level.
2.2 The conservatory will be around 1.5m from the boundary with number 3, Cronk Drine which is set at a higher level than the application property, by over 1m.
3.1 The site lies within an area designated on the Braddan Local Plan of 1991 as Predominantly Residential.
3.2 As such the proposal should be considered in respect of the provisions of General Policy 2 of the Strategic Plan:
"Development which is in accordance with the land use zoning and proposals in the appropriate Area Plan and with other policies of this Strategic Plan will normally be permitted, provided that the development:
b) respects the site and surroundings in terms of the siting, layout, scale, form, design and landscaping of buildings and the space around them; c) does not affect adversely the character of the surrounding landscape or townscape and g) does not affect adversely the amenity of local residents or the character of the locality."
PLANNING HISTORY 4.1 Planning permission does not appear to have been granted for the erection of the conservatory, which was built around 1990 and for which Building Control approval was granted. It may have been that at that time, permission was not required as the existing conservatory could have been considered to comply with the provisions for the erection of a conservatory under the then Permitted Development Order and the applicant may have been advised that planning permission was not necessary. The structure has clearly been in place for long enough for the issue of an enforcement notice not be possible.
REPRESENTATIONS 5.1 Highways Division indicate that they do not oppose the application.
ASSESSMENT 6.1 The new conservatory will not be publicly visible and is unlikely to have a significant impact on the property alongside, due mainly to the difference in levels between the two properties and the fact that there is already a conservatory of similar dimensions in this position. The conservatory will not have any significant impact on the amenities or function of the public house behind nor vice versa. 6.2 In summary, it is considered that the proposal complies with the provisions of General Policy 2 and is considered acceptable.
PARTY STATUS 7.1 The local authority, Braddan Parish Commissioners are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (d), considered "interested persons" and as such should be afforded party status. 7.2 The Highway Authority is now part of the Department of Infrastructure of which the Planning Authority is part. As such, the Highway Authority cannot be afforded party status in this case.

C 2. This approval relates to the erection of a replacement conservatory as shown in drawings 100, 101 and 102 all received on 4th July, 2013 and the development must be undertaken in accordance with these drawings.
