1.1 The application site is the curtilage of 19 Michael Street, Peel which is a three storey mid terrace property situated to the northern side of the highway. The property is fairly run-down and is in need of renovation. The adjoining property 15 Michael Street is also within the ownership of the applicant, and this has had some works carried out, such as the installation of replacement windows.
1.2 The application site has the original timber sliding sash windows still in place in the first and second floor. The windows in the ground floor are shop front style windows.
2.1 The application seeks approval for the installation of timber sliding sash windows to replace the original rotten timber sliding sash windows. The windows would replace the first and second floor windows.
3.1 There was a previous application in 1993 which was for replacement windows (PA 93/01059/B) this application was approved.
4.1 The application site is within an area zoned as "Mixed Use" identified on the Peel Local Plan 1989. It is also within the Peel Conservation Area. Given the nature of the application it is appropriate to consider Environment Policy 35 of the Isle of Man Strategic Plan (2007) and Planning Circular 1/98.
Within Conservation Areas, the Department will permit only development which would preserve or enhance the character or appearance of the Area, and will ensure that the special features contributing to the character and quality are protected against inappropriate development.
If the original windows are in place they should preferably be repaired. If repair is impracticable, replacement windows which would be readily visible from a public thoroughfare must have the same method of opening as the originals. Whatever the

material used in their construction, the windows must have the same pattern and section of glazing bars and the same frame sections as the original windows.
Windows not readily visible from a public thoroughfare must have the same or similar pattern of glazing bars as the originals, but not necessarily the original method of opening, whatever the material used in the construction.
5.0 CONSULTATIONS 5.1 Peel Commissioners recommend approval.
6.0 ASSESSMENT 6.1 The application seeks approval for the installation of replacement windows at first and second floor. The main issue to consider in the assessment of the application is the impact upon the character and appearance of the Conservation Area. 6.2 The proposed windows would be hardwood timber sliding sash windows which would replace the original timber sliding sash windows. 6.3 As mentioned above the property is in need of renovation, it is considered that the installation of windows with the same method of opening, use of materials and glazing bars would enhance the character and appearance of the property and would therefore be in accordance with Environment Policy 35 and Planning Circular 1/98. 6.4 For the above reasons the application is considered to be acceptable and is recommended for approval.
7.1 The local authority, Peel Commissioners is, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (d), considered an "interested person" and as such should be afforded party status.

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.

This permission relates to the installation of replacement windows in the front elevation as shown in drawings, front elevation, and location plan received 2nd April 2013 and window details received 22nd April 2013.
I confirm that this decision accords with the appropriate Government Circular delegating functions to Director of Planning and Building Control / Development Control Manager / Senior Planning Officer.
