The application site is the curtilage of Quadrant House, 3 The Quay, Port St Mary. The existing property is a three storey terrace property with additional living accommodation in the roof space. The application site is to the South side of The Quay.
Proposed is the installation of a replacement window. The existing window is hardwood; the replacement window would also be of hardwood. The replacement window would have a smaller central fixed window with top hung sliding sash adjoining the central fixed window.
There are no previous planning applications for this site.
The application site is within an area zoned as "Residential" identified on the Port St Mary Village Plan 2001. It is appropriate to consider Planning Circular 1/98 in the assessment of the current application. It is also within the proposed Conservation Area, although it is not within a Conservation Area it is still appropriate to consider Environment Policy 35 of the Isle of Man Strategic Plan (20th June 2007).

Given the nature of the application, it is appropriate to consider Planning Circular 1/98 which states:
"In an individual building, or group of buildings, whose principal elevations are readily visible from a public thoroughfare, if the original windows are in place, it may be possible to repair and renovate them. This can take place without permission, and will be encouraged by the Department. If repair is impracticable, or existing windows are not the originals, the preference will be for replacement windows in the said principal elevations to have the same method of opening as the originals. Whatever the material used in their construction, the windows must have the same or similar pattern and section of glazing bars and the same or similar frame sections as the original windows."
It is also appropriate to consider Environment Policy 35, which states:
"Within Conservation Areas, the Department will permit only development which would preserve or enhance the character or appearance of the Area, and will ensure that the special features contributing to the character and quality are protected against inappropriate development."
The existing window does not contribute to the character and appearance of the property or the surrounding area in general.
It is considered that the proposed replacement window would enhance the character and appearance of the property, the two windows which would adjoin the central fixed window would be more appropriate in size and design as opposed to the existing.
For the above reasons, it is considered that the proposed window would contribute towards the property; therefore the application is recommended for approval.
The local authority is, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered an "interested person" and as such should be afforded party status.
The Department of Transport Highways and Traffic Division is now part of the Department of Infrastructure of which the planning authority is part. As such, the Highways and Traffic Division cannot be afforded party status in this instance.
