The application site represents the residential curtilage of Stronsay, 15 High Street, Port St Mary. The existing property is a two storey mid terrace dwelling situated to the West of High Street. The property also has additional living accommodation within the roof space.
Proposed is the installation of replacement windows in the front elevation. There is an existing timber shop window at ground floor level, and the windows at first floor level are timber sliding sash. The ground floor window would be replaced with uPVC sliding sash, and the large opening bricked up. The first floor windows would be uPVC sliding sash.
The previous planning application is considered specifically material in the assessment of the current application: PA 06/01446/B Installation of a timber sliding sash window and blockwork to replace existing shop front window to front elevation The above application was permitted.
The application site is within an area zoned as "Mixed Use โ Retail, Offices, Industry, Residential or Tourism" identified on the Port St Mary Draft Area Plan 2001. It is appropriate to consider Planning Circular 1/98.
Highways Division have not commented Port St Mary Commissioners have no objections.
Given the nature of the application it is appropriate to consider Planning Circular 1/98 which states:
"In an individual building, or group of buildings, whose principal elevations are readily visible from a public thoroughfare, if the original windows are in place, it may be possible to repair and renovate them. This can take place without permission, and will be encouraged by the Department. If repair is impracticable, or existing windows are not the originals, the preference will be for the replacement windows in the said principal elevations to have the same method of opening as the originals. Whatever the material used in their construction, the windows must have the same or similar pattern and section of glazing bars and the same or similar frame sections as the original windows."
The application seeks approval for the installation of replacement windows in the front elevation. The proposed windows would be uPVC sliding sash, it is considered that the replacement windows would add to the character and appearance of the property.
It is judged that the installation of a sliding sash window to replace the existing timber shop front window would be more in keeping with the street scene.
For the above reasons the application is considered to be acceptable and is recommended for approval.
The local authority is, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered an "interested person" and as such should be afforded party status.
The Department of Transport Highways and Traffic Division is now part of the Department of Infrastructure of which the planning authority is part. As such, the Highways and Traffic Division cannot be afforded party status in this instance.

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.
C 2. This permission relates to the alterations and installation of replacement windows shown in drawings 0512 A/01, 0512 A/02 Rev B and Photographs received 1st September 2010.
I confirm that this decision accords with the appropriate Government Circular delegating functions to the Senior Planning Officer.
