On 14th January 2013, and in pursuance of powers granted under the above Act and Order, the Department of Infrastructure determined to REFUSE planning application 12/01546/B by Mr & Mrs James Simpson for the Demolition of existing barn and erection of a building to provide guest accommodation, garage, gym and amendments to PA 11/01518/B at Ballacaroon Farm West Baldwin Road Mount Rule Isle Of Man IM4 4HS for the following reason(s):
- The building proposed for use as guest accommodation/garage and playroom would be tantamount to the erection of an additional dwelling in the countryside, contrary to established planning policies aimed at protecting the Manx countryside and directing new residential development to locations that accord with sustainable development principles. For these reasons the proposal would be contrary to General Policy 3, Environmental Policies 1 & 2 and Housing Policy 4 of the Isle of Man Strategic Plan.
- The building proposed as guest accommodation/garage and playroom is contrary to the provisions of General Policy 3, Environment Policy 1 and Environment Policy 2 of the Isle of Man Strategic Plan in that, by reason of its scale, massing and design it would represent an unwarranted and visually harmful development within the countryside and an area of high landscape or coastal value and scenic significance.
- The proposed dwelling would result in a building of far greater mass and scale that the building which it is to replace, presenting a greater intrusion into the countryside within an area designated as High Landscape or Coastal Value and Scenic Significance contrary to Housing Policy 14 and Environment Policy 2 of the Isle of Man Strategic Plan.

This decision was made by the Planning Committee in accordance with the authority delegated to it.
Any appeal against this decision must be in writing and must be received by this Department within 21 days of the date of this notice.

If no appeal is lodged within 21 days of the date of issue overleaf, and this decision becomes final, the Department’s public reference copy (counter copy) of the planning application may be collected by the applicant or their agent from Murray House.
Please note that if the counter copy of the application is not collected within THIRTY DAYS following the last date on which a planning appeal can be made it will be destroyed without further notice.
