THIS APPLICATION IS REFERRED TO THE PLANNING COMMITTEE RATHER THAN BEING CONSIDERED UNDER DELEGATED POWERS AS THERE IS AN OBJECTION FROM THE LOCAL AUTHORITY AND THE APPLICATION IS RECOMMENDED FOR APPROVAL.
The site represents the curtilage of the Rushen Abbey Hotel, a former public house which has been taken over by Manx National Heritage and has recently been refurbished for use partly in association with the Rushen Abbey site to the south which is now an interpretative centre for the former monastery and burial sites within the grounds.
The Rushen Abbey Hotel is a free standing building with an area of hard standing directly in front, used for car parking to the hotel and the Rushen Abbey site. At the rear of the building there is an enclosed courtyard/garden, none of which is visible from the public road alongside.
The site lies within an area designated on the Town and Country Planning (Development Plan) Order 1982 as High Landscape Value and Scenic Significance. On the draft Southern Area Plan which was published on 23rd October, 2009 the site lies within an area of Residential use. The site lies within the Silverdale Conservation Area.

Now proposed is the installation of signage in the form of a projecting sign on the front of the building and individual lettering and a crest on the frontage itself on the projecting single storey annex, all indicating that the premises is named "The Abbey" and that it is a restaurant. The lettering is of various sizes but all fits within the horizontal section above the windows and the projecting sign fits within the height of the first floor windows.
Malew Parish Commissioners indicate that they feel that the signage should be in the original position - ie on the main building as it was originally positioned.
The Strategic plan provides guidance on signage as follows: General Policy 6: "Within our towns and villages, the display of external advertisements will be permitted on the site or building to which they relate provided they: a) are of a high standard of design and material and relate well to the building and site on which they are to be displayed; b) are in keeping with and do not detract from the surrounding area; and c) are located so as to not cause a highway safety hazard" (General Policy 6).
General Policy 7: "Within our towns and villages, the display of external advertisements on sites or buildings other than those to which they related will not generally be permitted".
Environment Policy 37: "As a general policy, advertisements within Conservation Areas will be permitted if: i) the proposal preserves or enhances the Conservation Area; ii) the signage is in a style appropriate to the character of the area; iii) traditional materials and finishes are used and glossy and highly reflective materials are excluded from proposals; and iv) internally illuminated box fascia and projecting box signs are excluded from the proposals".
In this case the signage is minimalistic and appropriate to the character and appearance of the property which is a prominent one in the landscape and the signage will enhance the appearance of the property by indicating the use of the building and providing a name for the property which has almost always been a commercial property whose function involves the attraction of trade, of which, signage is an integral part.
As such the signage is considered to be acceptable.
The local authority is, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (d), considered an "interested person" and as such should be afforded party status.

This permission relates to the installation of signage as shown and described in drawings reference K225/P-10-01, K225/P-12-02, K225/P-12-03 and K225/P-12-04 all received on 12th April 2010.
The development hereby permitted shall commence before the expiration of four years from the date of this notice.
