The site represents the curtilage of The Pink House, Maughold, which is a two storey detached property which is located with the centre of Maughold Village, west of Maughold Parish Church.
The application site is within an area recognised as being an area of 'white lane' not zoned for development, under the Isle of Man Development Plan Order 1982. The site is within a Conservation Area; nor within an area zoned as High Landscape or Coastal Value and Scenic Significance.
Due to the zoning of the site and the proposal the following policy is relevant for consideration:-
"Environment
Policy 35: Within Conservation Areas, the Department will permit only development which would preserve or enhance the character or appearance of the Area, and will ensure that the special features contributing to the character and quality are protected against inappropriate development."
There following previous planning application are considered relevant in the assessment and determination of this application:-
Variation of condition to provide casement windows to approved alterations (0200147B) - 02/01508/B - REFUSED for the following reason:- "The property is within Maughold's Conservation Area and is a prominent one alongside the public highway. Whilst permission has already been granted for the installation of casement windows in the main body of the house, these new windows are considered to be a very prominent feature and more easily visible than the others in the building. As such, the windows should be of an appropriately traditional form and should be sliding sash as have already been approved under PA 02/0147."
Alterations to rear roof including the installation of three dormer windows - 02/00147/B - APPROVED Installation of replacement windows - 01/02492/B - APPROVED Installation of two windows to replace existing - 99/02267/B - APPROVED Replacement of windows - 94/00959/B - REFUSED
The application seeks approval for the installation of replacement windows. There are a total of 12 windows proposed to be replaced to the front, side and rear elevations. All existing windows are timber windows with the majority being a type of casement window. None of the replacement windows are sliding sash windows. The proposal would be replaced with timber windows 'like for like' including the vertical bar (front only) and with the decorative horns.
Maughold Commissioners:- "No Objection" The Planning Authority has received no privately written representations objecting to the proposal.
As the site is within a Conservation Area, Environment Policy 35 is relevant for consideration. This policy states that development will only be permitted which would preserve or enhance the character or appearance of the Area.
As indicated within the proposal section of this report, currently the first and second floor windows are a mixture of timber casement windows which vary in size.
Planning applications 99/02267/B and 01/02492/B, allowed the original sliding sash windows to be replaced by top opening casement windows. The site was within a Conservation Area at this stage. For these reasons the original sliding sash windows where replaced with the current casement windows. In some situations the Planning Authority has allowed top opening casement windows when the existing windows were of poor form in design and appearance. This was considered appropriate as in some situations top opening casement windows whilst not preferred, would be an enhancement to the conservation area given the adverse visual impacts of the existing windows.
If the property now still retained such timber sliding sash windows it is unlikely permission would be granted for top opening casements windows, even if they were proposed to be timber.
However, this is not the case given to previous history and therefore consideration must be taken with regard to Environmental Policy 35. After visiting the area, studying the plans and discussing the application with the Conversation Officer, it is considered the proposal would not enhance the area, but would preserve what currently exists.
It is therefore considered given the existing window fenestration the installation of timber casement windows 'like for like' would be appropriate and therefore comply with Environment Policy 35 of the Isle of Man Strategic Plan.
RECOMMENDATION In conclusion, it is recommended that the planning application be approved on the planning policy grounds that the proposed development would be acceptable to the Isle of Man Strategic Plan (June 2007).
PARTY STATUS It is considered that the following meet the criteria of Government Circular 1/06 and should be afforded interested party status:
Maughold Commissioners
The Department of Transport Highways and Traffic Division is now part of the Department of Infrastructure of which the planning authority is part. As such, the Highways and Traffic Division cannot be afforded party status in this instance.

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.
C 2. This approval relates to the installation of replacement windows as tourist accommodation as proposed in the submitted documents and drawings LOC 1, PLAN 1, PLAN 2 and PLAN 3 received on 4th March 2010, 12 March 2010 and 12th May 2010.
C 3. For the avoidance of doubt, all replacement windows are to be timber in material, with decorative horns and vertical bars as per existing windows.
I confirm that this decision accords with the appropriate Government Circular delegating functions to the Senior Planning Officer.
