The Site
The application site relates to Kion Slieu Plantation, Lhoobs Road, Eairy, Patrick. The plantation is on the southern side of the road.
The Proposal
This application seeks approval for the creation of a temporary vehicular access and hardstanding to allow the timber lorry to reverse into the plantation to load without obstructing the highway and causing a hazard to road users.
The application supporting letter sets out that the access would be required for approximately 6 months and once the harvesting of the plantation is complete the grass verge and sod bank would be re-instated.
Planning Status
The application site is identified as a plantation by the 1982 Development Order and is located within a wider area recognised as being white land (open countryside).
General Policy 3 of the Isle of Man Strategic Plan 2007 sets out the exceptions to the presumption of development in the countryside. Part (f) makes provision for "building and engineering operations which are essential for the conduct of agriculture or forestry"
PLANNING HISTORY There have been no previous planning applications relating to this site.
REPRESENTATIONS Patrick Parish Commissioners have not commented on this application. The Department of Transport Highways Division does not object to this application.
ASSESSMENT The proposal is judged to be essential for the conduct of forestry and as such the impacts of the development must be balanced against the need to work the land.
In this case the proposal would allow safe access to the plantation and the changes to the existing bank would be relatively short-lived with the works being in place for approximately 6 months. It is judged that the proposed development is sufficiently justified and would not have long term unacceptable impacts upon the countryside.
RECOMMENDATION Permit.

C 1. This approval relates to the creation of a temporary vehicular access and hard standing, Kion Slieu Plantation, Lhoobs Road, Eairy, Foxdale, Patrick as shown by MAP1, MAP2, MAP3, MAP4, Photographs 1-6 and Support Letter all received 12th February 2010.
C 2. Within 12 months from the date of this approval, the temporary access, including any hardcore must be removed and the bank restored to match the bank either side of the access.
