The site defined in red represents part of the curtilage of Malew Parish Church, a traditional church building sitting in an otherwise relatively isolated landscape between Great Meadow and Malew House, to the south west of Cross Four Ways. The Church sits within its graveyard with an additional section of cemetery sitting on the south eastern side of the road which is identified in blue.
The church itself is a T-shaped building orientated west - east as many churches are, built in stone and finished in a white painted render with a naturally slated roof and a bell tower at the western end.
The site lies within an area designated on the Town and Country Planning (Development Plan) Order 1982 as "Worship" and within the draft Southern Area Plan which was published on 23rd October, 2009 the site is not specifically designated for a particular use but the Registered Building status is
acknowledged. The site is part of an area of Incised Slopes on the Landscape Character Assessment plan. The application building was Registered in April 2008.
PLANNING HISTORY The following applications have been considered in respect of this site: PA 00/0870 - siting of an oil tank - permitted PA 06/1432 - erection of an extension to the rear of the church, creation of a lych gate and churchyard store - permitted on appeal
THE PROPOSAL Now proposed is an amendment to the extension part of the scheme. The approved extension took the form of a detached building linked to the church by a glazed structure. After this was costed, the church was not in a position to be able to afford the works and as such the proposal to create additional space has been modified to take the form of a detached building which involves no change to the existing structure, the creation of overall less new floorspace and the provision of a larger disabled person's toilet facility. The approved scheme involved the creation of a grass roof on the extension as it would have been visible to those within the church. As this will no longer be visible to those crossing the existing staircase, the grassed roof has now been omitted from the scheme and the roof is to be finished in fibreglass. The walls are to be finished in natural stone with relocated gravestones attached to the external walls with brackets.
REPRESENTATIONS Department of Transport Highways and Traffic Division (now part of the Department of Infrastructure) indicate that they do not object to the application
Malew Parish Commissioners indicate that they do not oppose the application The Manx Electricity Authority indicate that the applicant should discuss the provision of existing and proposed electricity to the development. This is not a material planning consideration (there are no existing overhead services) and as such should not be referred to in the planning decision notice.
ASSESSMENT The proposed development is relatively similar to the approved scheme other than it will not have the grassed roof and will not involved a glazed link tot he main church nor any change to the fabric of the church itself. When completed the building should look like a structure which has always been alongside the church, not imitating it but complementing it and providing facilities - a toilet, store for use by those visiting or working within the churchyard.
PARTY STATUS The local authority is, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (d), considered an "interested person" and as such should be afforded party status.
The Department of Transport Highways and Traffic Division is now part of the Department of Infrastructure of which the planning authority is part. As such, the Highways and Traffic Division cannot be afforded party status in this instance.
