The site represents the curtilage of an existing terraced property situated on the south western side of Bay View Road opposite the road bridge under which the recent landslip occurred. The property is a three and a half storey building with a shop on the ground floor with three floors of accommodation above whose use is not specified in the application form or plans. The ground floor has a shop frontage at ground floor level with a projecting bow window on the first floor in an otherwise flat frontage to the main road. The windows are arch-headed on the first floor and round-headed on the second and attic floors. To the north of the site is a newsagent's and to the south is a chemist's.
The site lies within an area designated on the Isle of Man Planning Scheme (Development Plan) Order 1982 as Retail and on the draft Southern Area Plan published on 23rd October, 2009 as Mixed Use which reflects more accurately the variety of uses in the area and the mixture of uses within the building itself. The Southern Plan also outlines a proposed Conservation Area which includes much of the older buildings in and around the village centre and includes this site and most of Bay View Road.
Planning permission was sought and granted for the erection of an illuminated sign under PA 85/0178 and for an extension into the rear yard to provide a consultation room under PA 06/1720.
Planning permission is also currently being sought for signage - PA 10/0016. 22 February 2010 10 / 00015 / B
Now proposed is the conversion of the existing bank on the ground floor to a chemist's shop including the replacement of the shopfront with a full length glass system of windows with aluminium frames.
As the existing use is a bank, this falls within Class 2 of the Use Classes Order whereas a chemist's shop falls within Class 1.
Port St. Mary Commissioners and Department of Transport Highways and Traffic Division indicate that they do not object to the application or that for the proposed signage.
The existing shopfront is poor in appearance, detailing and condition and as such the proposed removal of this is welcome. It is disappointing that the applicant has chosen to install a rather bland aluminium framed frontage which reflects the style of the more modern shopfronts in Bay View Road rather than emulating the older shopfronts, such as that of the picture framer's, whose frame section is more refined and interesting, or the divers' shop to the south, which has stained glass detailing in the top lights. The applicant has been approached to consider a timber shopfront, but has declined, preferring the standard aluminium frame which has been installed elsewhere on the Island. This approach has also been adopted recently, with approval within Michael Street in Peel, (PA 09/1623) within an adopted Conservation Area where the aluminium shopfront was permitted.
As this site is not within an adopted Conservation Area and as the existing shopfront is of such poor appearance, it is not felt that it would be appropriate to object to this application, although a timber shopfront with more interesting detailing would have contributed more significantly to the streetscene.
The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.
C 2. This permission relates to the replacement of the existing shopfront as shown and described in drawings reference 002 and 003 both received on 6th January, 2010.
