The application site represents the curtilage of "Pumpkin Patch Day Nursery" Hailwood Court which is an existing building which leads off Johnny Wattersons Lane and Hailwood Avenue in the built up residential area of Governors Hill in Douglas.

The application site is within an area of "Predominantly Residential Use" under the Douglas North Local Plan, which was adopted by Tynwald in 1998. Douglas Corporation has no objection with the proposed development.
The Department of Transport Highways Division do not oppose has no traffic management, parking or road safety implications.

ASSESSMENT
After a visit to the site it was clear that the proposed alterations to the boundary treatment would be acceptable as they would be at an appropriate height; and they would neither adversely affect the character of the locality or the public or private residential amenity of the adjacent property (9 Fuchsia Lane) to the north east.
The remaining alterations are considered to be appropriate for premises of this nature, as they are proposing features which would increase the safety of children who attend the Pumpkin Patch Day Nursery, for example, erecting new gates, railings and safe play surface to external area. As such, with matching materials throughout, the proposed development would not detract from the character of the property and would ensure that the visual amenities of the locality are protected when viewed from the public thoroughfare.
RECOMMENDATION For these reasons the proposal is considered acceptable and it is recommended that the planning application be permitted. PARTY STATUS
