The site represents the curtilage of St. Mary's Bay - a block of apartments situated on The Promenade in Port St. Mary almost opposite the Town Hall. The building is relatively new, compared with most of the buildings on the promenade and has car parking at the rear with access around both sides of the building.
The site lies within an area designated on the Isle of Man Planning Scheme (Development Plan) Order 1982 as Predominantly Tourist Accommodation. On the draft Southern Area Plan published on 23rd October, 2009 the site is identified as Predominantly Residential and the building is specifically excepted from the proposed Conservation Area identified in this document.
The following applications have been submitted in respect of this site:

Proposed now is the conversion of the sunroom to a two bedroomed apartment. Whilst planning permission has been granted for the conversion of this area to a single bed apartment, this now proposes a two bedroomed apartment within the same area which is on the ground floor and to the left of the front door as one enters the building.
There will be 12 apartments and 24 parking spaces. There is a public car park next door but one to the site for any overspill.
Department of Transport Highways and Traffic Division raise no objection to the application. Port St. Mary Commissioners query whether planning permission is needed if the application is simply to change the approved apartment internally. However as the previous application was not implemented, this is a fresh application which requires permission. The Commissioners have no objection to the scheme.
The Environmental Health Inspectorate write to the applicant and advise that the flat will require to be registered under the Housing (Flats) Regulations 1982. This is not a material planning consideration and should not be referred to in the planning decision notice.
The proposed development will create a new apartment without any modification to the existing fabric. There is sufficient parking to accommodate the parking required for the new apartment without change to the existing arrangement. Whether the apartment has one or two bedrooms is not of material consideration as the apartment is the same size as that already permitted and its internal layout and arrangement is not the subject of planning control.
PARTY STATUS The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.
The Environmental Health Directorate raise issues which are the responsibility of other legislation and as such should not be afforded party status.

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.
C 2. This permission relates to the conversion of the existing sun room to an apartment as shown and described in plans reference 9426-21A, Location Plan 1 and P ELV 1 all received on 27th January, 2010.
