Pizza Hut, 1-5, Walpole Avenue, Douglas, Isle Of Man, IM1 2lt
The application sought to vary condition 2 of previous approval PA 09/01313/C, which limited Pizza Hut's operation to 08:00-23:00 daily (midnight during TT and Grand Prix fortnights), proposing extension to midnight daily except 02:15am during TT and Isle of Man Festival of Motorcycling fortnights.

The key considerations were impact on amenities of adjacent properties and potential anti-social behaviour. Adjacent properties are similar uses like a bar, restaurant and nightclub open until 3am on …
General Policy 2
Requires consideration of impact on amenity and character of locality. Assessed as compliant due to no undue impact on adjacent non-residential uses from the one-hour extension in a mixed-use town centre area.
General Policy 2
Requires paying due regard to community and personal safety to prevent criminal and anti-social behaviour. Officer balanced allowance of late-night food provision in town centre against risks, finding midnight acceptable given police presence and existing hotter spots.
Community Policy 7
Addresses community safety and prevention of anti-social behaviour. Proposal met this as anti-social risks were contained by location amid similar uses and no police objection.
Time limit
The development hereby approved shall be begun before the expiration of four years from the date of this decision notice. Reason: To comply with article 14 of the Town and Country Planning (Development Procedure) (No2) Order 2013 and to avoid the accumulation of unimplemented planning approvals.
Opening hours
This approval relates to the use of the premises as a restaurant/cafe and takeaway: the premises may be open only within the period 08:00 to midnight each day, except during TT fortnight and the Isle of Man Festival of Motorcycling fortnight when the operation may continue until 02:15 am. All customers must have left the premises within 10 minutes of the closing time. Reasons: In the interests of environmental amenity and prevention of crime.
No objection.
No concerns/objections to the proposed variation (on the assumption that the new hours would similarly be controlled by condition).
Environmental Health officers expressed mixed views on extending opening hours due to potential noise and disturbance from late-night takeaway crowds but confirmed good hygiene standards and no current issues; Police and Douglas Borough Council raised no objections.
Key concern: potential public disturbance and noise to adjacent residents from drunken crowds gathering at takeaways after pubs close
Food Safety Manager (Ivan Bratty)
Conditional No Objectionif you are to take into consideration the number of complaints, mainly received by the police with regard to public disturbance, noise to adjacent residents etc. that emanate from takeaways when drunken crowds gather after the pubs close, then the decision to limit the opening hours to 23.00 hours was probably the correct decision in the first place.
Environmental Health Officer (Phil Faragher)
No ObjectionI would concur with his comments regarding opening hours.; the premises were found to be well run and maintained. A good standard of hygiene was being achieved backed up by a comprehensive documented HACCP/Management item.; I am not aware at this time of any noise or order issues at the premises.
Police (Mike Radcliffe)
No Objectionthe police have no concerns/objections to the proposed variation (on the assumption that the new hours would similarly be controlled by a similar trading hours condition)
Douglas Borough Council
No ObjectionDouglas Borough Council have no objection to the proposals
