Further to your letter dated 17th June 2014 in connection with the above.
The proposal site is situated on the recently widened pavement to the front of “La Piazza Restaurant and Pizzeria” on Loch Promenade. The applicant’s premises are located at first floor level with windows / balcony that overlook the proposed external seating area. The use of the site as external seating associated with “La Piazza”, will be in keeping with the area and the character of the conservation area would be preserved.
The proposal external seating area and signage complies with general policy 1, 2 and 6 and Environmental policies 35 and 37. A 3.5 m wide unobstructed pedestrian passage is to be retained on the existing pavement as part of the proposal, which is a requirement of the highway authority. Suitable toilet facilities are already available within the existing restaurant to cater for customers. The proposal can be observed from inside the applicant’s premises and will be contained within a suitable barrier incorporating a tapper rail for partially sighted persons. The seating area would be arranged to cater for disabled persons and wheelchair users in accordance with statutory authority requirements.
We confirm that all the suggested planning conditions listed within the planning authorities case statement are acceptable to the applicants.
