Officer’s Report
1.0 DESCRIPTION - 1.1 The proposed application 23/01407/B for The construction of a new Sewage Treatment Works and creation of new vehicular access was approved following an appeal on the 20.12.2024 subject to 5 conditions some of which required submission of additional information prior to the commencement of work - 1.2 This report is specific to condition 16 which the applicants are seeking to satisfy. - 1.3 Specific wording of the condition is as follows: River Neb No work shall be undertaken adjacent to the River Neb other than in accordance with a scheme to limit potential impacts on the River's fish population, which scheme shall previously have been submitted to and approved in writing by the Department.
Reason: In order to protect aquatic habitat and species pursuant to Environment Policy 8 of the Strategic Plan.
2.0 PROPOSAL - 2.1 The applicants have submitted detailed plans, method statements and additional details of the headwall and millrace pipe crossings along with a duly completed application form received on 02.05.2024. - 2.2 The method statement that has been provided is in relation to the River Neb Out Fall & Mill Race Pipe Crossings. A plan has been provided that clearly outlined the location of the works adjacent to the River Neb. The applicants have also covered the scope of the works which indicates that the scheme involves the excavation and installation of a new surface water out fall pipe from the new RSTS site out the river neb. - 2.3 All contact details for relevant contractors have been provided as well as a list of relevant documentation which covers: Risk Assessments, Statuary Notifications, Environmental Aspects, Additional Control Measures and CoSHH Assessments. - 2.4 Plans and sketches have been provided which also included a detailed section drawing of the angled precast concrete outfall headwall. - 2.5 Methodology/ Sequence has been outlined and is as follows Start Up:
- 1. Induct All Staff (visitors).
- 2. Go through the proposed scope of works & PCS H&S Documentation.
- 3. Ensure that all personnel have read, UNDERSTOOD, and signed the RAMS.
- 4. Maintain communication with The Clients Team
- 5. Only currently competent suitably trained, experienced, and certified personnel are to be employed.
- 6. All plant will be regularly checked, inspected, and certified.
- 7. A pre-condition photographic survey is to be carried out by PCS Limited.
- 8. Close liaison with DEFA (Fisheries)
- 9. Erect fencing and signage as agreed.
- 10. Ensure that there is suitable and sufficient segregation between the works area and the public.
- 11. Set up traffic management in accordance with the Pedestrian & Traffic Management Plan.
- 2.5.1 The Method of Operations is as follows Pedestrian Management & Site Set Up:
- 1. The site MUST be securely fenced.
- 2. The works area will have signage placed around warning of the dangers associated with these works.
- 3. All heras fencing is to be double clipped.
- 4. The works area fencing will be suitably secured for poor weather conditions.
- 5. There are two pedestrian footpaths that run through the proposed works, only one footpath will be closed at once and the pedestrians will be diverted to the other.
- 6. The pedestrian management will be erected in accordance with the accepted Management Plan.
- 7. The Pedestrian management set up will be secured, weighted down, and checked daily.
- 2.5.2 Also noted is the following -
- 1. Fisheries MUST be notified if any alterations are to be made to the agreed method of works.
- 2. Electrofishing of the watercourse must occur before any excavation commence in working area, including before the sedimats are installed and temp coffer dam is placed.
- 3. Phase must also allow electrofishing of the site before operations begin on this.
- 4. Sedimats need refreshing as required.
- 5. PCS must be ready to begin work immediately after de-fishing has been completed.
- 6. Sedimats must be removed on completion of works.
- 7. If/when sedimatts are used, Fisheries are to be informed as soon as possible if the sedimats/cofferdams are breached due to flooding, works are to cease until Fisheries have been consulted.
- 2.5.3 Procedures are outlined as:
- 1. All Personnel involved in this operation to be briefed on the method prior to commencement.
- 2. Only suitably trained, experienced and certified personnel to be employed.
- 3. The routes of pipeline will be as per the current construction drawings.
- 4. A pre-commencement photographic survey will be carried out.
- 5. No overloading of excavation will be permitted.
- 6. Access to the working area will only be via agreed access/egress points.
- 7. The site is to be well segregated.
- 8. The excavation, gradients and direction will be as per the design.
- 9. All staff will be suitably trained.
- 10. The banksman will check the depth of dig to allow correct bed.
- 11. Trench support must be always considered.
- 12. Pipe bedding and backfill material will be used as specified.
- 13. Plant will operate within the site spread.
- 14. Any unknown services located during these works will be treated as live until additional information can be obtained. Plans will be made available to the site team.
- 15. Excavated material will be removed from the working face as the work progress, so as not to contaminate the watercourse. This may need to be stockpiled away from the work area.
- 16. All loading, unloading of plant will be supervised by a nominated Banksman.
- 17. All vehicles, plant and machinery will have operating flashing beacons on.
- 18. Liaise with DEFA re clearing any vegetation from mill race channel and the top of bank to make it safer to work on. Any necessary permission for tree clearance to be obtained from DEFA and vegetation to be checked for nesting birds prior to removal.
- 19. Ensure that S18 & S20 Approval is in place.
- 20. Set up sediment mats in the stream using steel barriers making sure they are propped upon rock/ timber, liaise with fisheries when installing. 21. Construct a coffer dam around the area of works, the coffer dam will be constructed by using tope bags
- 2.5.4 Exact details of the Precast Headwall Unit and the Mill Race Pipe crossings have been provided within the method statement, as well as details for refuelling plant, details of supervision and the site emergency response plan.
- 2.5.5 Important contacts have also been provided which clearly highlights the Environmental Protection Unit and the Fisheries Directorate (both DEFA)
- 2.6 The applicants have provided correspondence between themselves and the Fisheries Directorate (Section 18 Confirmations). It is indicated that the works are planned to be
conducted outside & within the fisheries "working window" as defined by DEFA Fisheries Division. It is noted within this letter: "Please note that this consent, granted under Section 18 of the Fisheries Act 2012, does not negate other legal and statutory obligations, e.g. protection of birds and their nests under the Wildlife Act 1990."
3.0 CONSULTATION - 3.1 The recommending officer of the original application was consulted for advice on the satisfaction of condition. The advice received on (11.05.2025), after their review of the submitted documents, concludes that they are pleased to confirm that the information satisfies the relevant clauses. - 3.2 The Department's Inland Fishery Team were also consulted for advice. The advice received on (06.05.2025), after their review of the submitted documents, concludes that they are pleased to confirm that the information satisfies the relevant clauses.
- 3.2.1 The following comments were provided: "In regard to Information in relation to condition 16 of PA 23/01407/B providing details for a scheme to limit potential impacts on the River's fish population (River Neb), I can confirm the information adequately addresses the requirements of the condition as outlined within both Section 18 consents. I see no need for additions or amending. The applicant must pass methods statements for Department input before works begin." 06.05.2025
- 4.0 RECOMMENDATION 4.1 In the instance of the submitted details and after consultation with the case officer, who is happy with the level of detail, it is deemed sufficient to achieve the desired outcome and would be considered satisfactory for the planning condition 16 of planning application 23/01407/B, under the understanding that the development shall not be carried out unless in accordance with the approved details.
I can confirm that this decision has been made by a Principal Planner in accordance with the authority afforded to that Officer by the appropriate DEFA Delegation and that in making this decision the Officer has agreed the recommendation in relation to who should be afforded Interested Person Status.
