C 1. The works hereby granted registered building consent shall be begun before the expiration of four years from the date of this consent.
Reason: To comply with paragraph 2(2)(a) of schedule 3 of the Town and Country Planning Act 1999 and to avoid the accumulation of unimplemented registered building consents.
The proposal would preserve the character of the building, therefore preserving the Conservation Area and the setting of the Listed Building meeting the Statutory test of s16 and s18(4) of the Town and Country Planning Act (1999). The proposal overall accords with Planning Circular 1/98, Strategic Policy 3 and 4, General Policy 2 and Environment Policy 35 of the Isle of Man Strategic Plan 2016, and the Design Guide.
This decision relates to the following plans and detail received on the 26th of March 2025 and 27th of March 2025.

1.0 THE SITE - 1.1 The site relates no. 28 Christian Road Douglas. The terraced property comprises 4 floors of apartments, with the 4th floor occupying the roof space. The property is on the north side of Christian Road. - 1.2 Throughout the front façade of the building there are mouldings around the openings and under the eaves. Apart from the entrance door, the ground floor has a bay window comprising 3 openings. Between each terrace building there is a shared chimney stack with a row of chimney pots for each side of the building. The rear and outrigger elevations are relatively plain, painted brick.
2.0 THE PROPOSAL - 2.1 The application proposes removal of the chimney on the rear outrigger and to paint the rear elevation grey. This application is submitted in conjunction with application no.25/90272/B.
2.3 The application is supported by the appropriate plans. - 3.0 PLANNING POLICY
3.2 Strategic Policies Taking account of the above, within the adopted Isle of Man Strategic Plan 2016, the following policies are considered relevant in the determination of this application.
4.1 Planning Policy Statement 1/01 (Conservation of the Historic Environment of the Isle of Man) - Policy CA/2, (Conservation Areas); "When considering proposals for the possible development of any land or buildings which fall within the conservation area, the impact of such proposals upon the special character of the area, will be a material consideration when assessing the application.
4.2 Residential Design Guide (July 2021), Chapter 5 Architectural Details, 5.1 Chimneys; 5.3 Finishing and Detailing.
whether to grant registered building consent for any works, the relevant Department shall have special regard to the desirability of preserving the building or its setting or any features of special architectural or historic interest which it possesses.
5.1 In addition to the associated application given above, other planning history exists but none are relevant in determining this planning application. - 6.0 REPRESENTATIONS
7.1 Where traditional chimneys exist the preference is for them to be retained. Chimneys are an important feature within any roofscape, particularly when viewed cumulatively amongst period properties. Painted render, brick or stone facades are common throughout the island and of various colours. The key considerations for this assessment are whether the proposed works preserve the character of the site, and so the Conservation Area and the setting of the Registered Building.
7.2 In respect of painting the rear elevation, this elevation is already painted a pale colour; Re-painting in a light grey would preserve the character and so is acceptable. A new colour is proposed, grey, and there are examples of shades of grey in the vicinity. The facades proposed painted light grey are on the rear and opposite the frontages of Registered Building that is Harris Terrace. There is a mix of colours along Harris Terrace, as such the change in colour would not cause harm to the character of the building, or the streetscene. The character of the building, the Conservation Area and the setting of the Registered Building would be preserved.
7.3 In respect of the chimney proposed removed, this is on the rear and subservient to the buildings main roof. Within the terrace, other outrigger chimneys have already been removed. - 7.4 Loss of the chimney on the rear outrigger is regrettable and would cause harm to the character of the building. However because others have been removed, its loss would not cause adverse harm and would not be out of present character in the streetscene, and would not cause sufficient harm to warrant refusal. Overall the character of the building, the Conservation Area and the setting of the Registered Building would be preserved. - 7.5 In applying the test under section 18(4) of the Town and Country Planning Act (1999) as to whether the works preserve or enhance the Conservation Area. All of the proposed works would preserve the essential character of the Conservation Area. - 7.6 Having regard to the Town and Country Planning Act 1999, s16/18 the proposal would preserve the setting of the Registered Building, Harris Terrace.
8.1 The proposal would preserve the character of the building, therefore preserving the Conservation Area and the setting of the Listed Building meeting the Statutory test of s16 and s18(4) of the Town and Country Planning Act (1999).
8.2 The proposal overall accords with Planning Circular 1/98, Strategic Policy 3 and 4, General Policy 2 and Environment Policy 35 of the Isle of Man Strategic Plan 2016, and the Design Guide. - 9.0 Interested Person Status
9.1 By virtue of the Town and Country Planning (Registered Buildings) Regulations 2013, the following are automatically interested persons:
9.2 In addition to those above, the Regulation 9(3) requires the Department to decide which persons (if any) who have made representations with respect to the application, should be treated as having sufficient interest in the subject matter of the application to take part in any subsequent proceedings relating to the application.
I can confirm that this decision has been made by a Principal Planner in accordance with the authority afforded to that Officer by the appropriate DEFA Delegation and that in making this decision the Officer has agreed the recommendation in relation to who should be afforded interested person status and/or rights to appeal.
