Officer’s Report

1.0 Description - 1.1 The proposed application 23/01407/B for the construction of a new Sewage Treatment Works and creation of new vehicular access was approved at appeal on 16.07.2024 subject to 19 conditions, some of which required submission of additional information prior to the commencement of works. - 1.2 This report is specific to Condition (7) which the applicants are seeking to satisfy. - 1.3 Specific wording of the condition is as follows:

No works shall commence, including any works of site clearance and ground preparation, until a scheme for the mitigation of dust nuisance during the construction period has been submitted to and approved in writing by the Department. Development shall be carried out in accordance with the approved Plan.

REASON: In order to protect air quality for those living and working in the vicinity of the site.

2.0 Proposal - 2.1 The applicants have submitted details providing information for the mitigation of dust nuisance during the construction period along with a duly completed AIRC form on the 10.01.2025. - 2.2 The report outlines the following: Dust Management Plan (DMP) To combat the effects of dust inhalation, construction dust control regulations they will direct a three-pronged approach: Assess, Control, and Review. The Site Manager/s and Supervisors will be:

• o Assessing the risks of dust exposure in the workplace;
• o Implementing effective control measures to mitigate these risks;
• o Regularly reviewing and updating strategies to ensure continued effectiveness.

The site manager will be responsible for the implementation of this DMP and for ensuring that control measures in place are adhered to. In the absence of the site manager, responsibility of ensuring implementation of the DMP will be delegated to a suitably experienced site operative.

All staff members will receive the necessary training to deliver the dust suppression measures detailed within this DMP. Site procedures will be communicated to staff via site inductions and toolbox talks. Should the need arise to implement new dust suppression measures on site, additional training will be given to site staff to ensure they remain competent.

The DMP is to be reviewed on a monthly basis or in response to a complaint, environmental near misses or as a result of changes to activities on the site.

• 2.2.1 Sensitive receptors within site proximity -

• Users of adjacent Heritage Trail o Adjacent Highway user o Nursing Home and residential area East of Site o Residential/industrial Area due north of site. o Site operatives

Regular inspections/ visual monitoring to be undertaken at the boundaries with all potential receptors

• 2.2.2 Potential sources for dust and mitigations Activities/ sources of dust associated with these construction works are listed below. Where the emission of construction dust cannot be prevented, taking measures to prevent particles from getting into the air can minimise the health risk.
• 2.2.3 In line with the above, a detailed table has been provided outlining the source of potential dust pollution and the details for the mitigation of this. Proposed is:

Vehicles entering and leaving the site with mud on wheels and tracking mud/dust off the site. On site vehicle movements on unpaved haul routes:

• - Ensure where practical site surface clean from mud dust and debris.

• - Use wheel washing facilities at access egress
• - Unpaved roads to be dampened with water as required.
• - The works have been programmed for the access road to be constructed to tarmac level as a priority activity. This will minimise dust from getting airborne and allow for regular road sweeping/dampening to be undertaken to the site entrance and access road. Debris/dust from unsheeted vehicles delivering to or from site:
• - Vehicles to be covered or waste enclosed when transporting waste from site. Movement, tipping of construction materials:
• - Minimise source strength by means of low drop heights, minimise movement of stockpiles through forward planning Storage of construction materials:
• - Profiling and shielding of stockpiles from wind whipping, positioning sources away from receptors. Dampening down / wetting of materials. Sealing stockpiles.
• - Cutting breaking of construction materials: Ordering pre-cut materials whenever possible can significantly reduce the need for on-site cutting, minimising dust levels. This isn't always possible, and dust may still be present regardless, so it's also essential to provide appropriate personal protective equipment (PPE), such as face masks and protective clothing.
• - Dust suppression or extraction.

• 2.2.4 Dust Suppression and Road Sweeping The Site Manager will regularly monitor dust levels and ensure to maintain dust control equipment such as water bowsers, quick spray attachment for telehandlers (see example image below) etc. and roadsweepers. The Site Manager will monitor the site daily via visible checks and instruct for water dampening and/or sweeping to be undertaken should the dust levels exceed the typical levels. Should the typical level be exceeded, fine spraying of water will be used to suppress dust. Repeat spraying shall be provided regularly, especially during warm, sunny and dry weather when water will evaporate quickly.

3.0 Consultation - 3.1 Department's Environmental Protection Unit were also consulted for advice on the satisfaction of condition. The advice received 18.03.2025, after their review of the submitted documents, concludes that they are pleased to confirm that the information satisfies the relevant clauses.

• 3.1.1 Comments provided are: "EPU have no comments or concerns with any of the documents provided below. We're satisfied that all proposed waste facilities hold the appropriate waste disposal licences, and suitable measures are being taken to protect the watercourse from pollution." 18.03.2025
• 4.0 Recommendation 4.1 In this instance of the submitted documentation and after consultation with the case officer confirming that they are happy with the level of detail, it is deemed sufficient to achieve the desired outcome and would be considered satisfactory for the planning condition 7 of application 23/01407/B, under the understanding that the development shall not be carried out unless in accordance with the approved details.
